社区医疗废物控制的法律机制研究

【摘要】：本文首先分析了医疗废物在社区层面的特征。通过研究,明确了社区内医疗废物的产生特点、对环境的影响程度、处置方式等与城市的布局规划、居民的生活习惯及环保意识、社会经济发展水平等的关系,进而从建立健全公众参与机制、有效控制社区内医疗废物的产生、资源回收再利用、强化政府监管职能和鼓励市场化运作机制的参与等方面探讨如何完善环境保护问题中医疗废物控制的法律机制问题。本文第一部分主要研究医疗废物在社区层面的特征,归纳总结了源头分散性、终端消费性、处置困难性、低毒失控性和损害密切性等五个方面的特点;第二部分着重从医疗废物的处置原则着手,通过分析我国处置医疗废物的现状和介绍国外先进经验的启示,分析研究符合我国国情的在社区层面的医疗废物控制原则;第三部分从如何建立主体机制和制度机制两方面,通过借鉴一些发达国家在法律法规方面的成功经验,结合我国实际,提出了一些建设性的意见。本文研究主要从医疗废物的概念、分类、对环境的影响以及目前我国在社区层面医疗废物的产生、管理、利用现状出发,结合现行法律法规的具体规定和存在的盲区,着重从减少医疗废物的产生、合理的回收利用等方面进行讨论,通过借鉴国外医疗废物在法律层面管理的先进经验和模式,概括出符合我国国情的,在社区能够实现的具体做法。
[Abstract]:This paper first analyzes the characteristics of medical waste at the community level. Based on the research, the relationship between the characteristics of medical waste generation, the degree of influence on the environment, the way of disposal and the layout of the city, the living habits of residents, the consciousness of environmental protection, the level of social and economic development and so on are clarified. Then, we should establish and improve the mechanism of public participation, effectively control the generation of medical waste in the community, and recycle the resources. This paper discusses how to perfect the legal mechanism of medical waste control in environmental protection from the aspects of strengthening the function of government supervision and encouraging the participation of market-oriented operation mechanism. The first part of this paper mainly studies the characteristics of medical waste at the community level, summarizes the characteristics of the source of dispersion, terminal consumption, difficult to dispose of, low poison out of control and close damage. The second part focuses on the principles of medical waste disposal, through the analysis of the current situation of medical waste disposal in China and the introduction of foreign advanced experience inspiration, analysis and study of medical waste control principles at the community level in line with the national conditions of our country; The third part from how to establish the main body mechanism and the system mechanism, through drawing lessons from the successful experience of some developed countries in laws and regulations, combined with the reality of our country, put forward some constructive suggestions. This paper mainly studies the concept, classification, environmental impact of medical waste and the generation, management and utilization of medical waste at the community level in our country, combined with the specific provisions of the current laws and regulations and the existing blind areas. From the aspects of reducing the production of medical waste, reasonable recycling and so on, and by drawing lessons from the advanced experience and model of foreign medical waste management on the legal level, the paper generalizes that the medical waste is in line with the national conditions of our country. Specific practices that can be achieved in the community.
