论我国防控外来物种入侵的法律对策

【摘要】： 外来物种入侵对经济、人体健康以及生物多样性等造成极大危害,已成为一个全球性的生物污染问题。对外来入侵物种如何进行法律防控,是当今环境法学理论研究的热点问题之一。对此国际社会和世界主要国家制定了大量法律文件,来应对日益严重的外来物种入侵问题。我国目前的情况是没有一部专门管理外来物种入侵的法律,而且已经存在的法律法规还有很多有待完善的地方。在介绍和分析外来物种的概念、外来物种的危害和入侵途径,以及目前国际组织之间和世界主要先进国家为防控外来物种入侵所采取的法律对策方面的成就的基础上,对我国外来物种入侵的状况、我国防控外来物种入侵的法律对策的现状进行剖析,比较之后找出了我国目前防控外来物种入侵的法律对策方面所存在的一系列的不足,最后就如何完善我国防控外来物种入侵的法律体系提出办法。总结得出,防控外来物种入侵,不仅需要生物学、物理学、化学等的科学方法,更重要的是要从法律的层面落实防控外来物种入侵的措施；首先,我国要借鉴国际上的先进立法经验,更新立法理念,明确立法目的。其次,我国应当制定一部防控外来物种入侵的专门法律,严格遵循有关法律原则,并构建和完善我国防控外来物种入侵的一系列法律制度。再次,要培养高素质的执法队伍和明确各相关责任组织和相关责任人的法律责任。最后,要明确防控外来入侵物种的管理机构和管理体制,设定统一而协调的管理程序。本文的研究贡献不在于提出了创新性理论,而是在于对现有的法律理论、实践方法的补充和合理应用,期望达到对该领域的研究起到抛砖引玉的作用,并试图以此弥补目前该领域研究的些许不足和对我国防控外来物种入侵的实践提供一定的参考和支持。
[Abstract]:Alien species invasion has caused great harm to economy, human health and biodiversity, and has become a global problem of biological pollution. How to prevent and control invasive alien species by law is one of the hot issues in the field of environmental law. The international community and major countries in the world have formulated a large number of legal documents to deal with the growing problem of alien species invasion. The current situation in China is that there is no law specifically governing invasive alien species, and the existing laws and regulations still need to be improved. On the basis of the introduction and analysis of the concept of alien species, the hazards of alien species and the means of invasion, as well as the current achievements in legal responses between international organizations and major advanced countries in the world to prevent and control the invasion of alien species, This paper analyzes the status of alien species invasion in China and the current situation of legal countermeasures to prevent and control alien species invasion in China. After comparison, it finds out a series of deficiencies in the legal countermeasures of preventing and controlling alien species invasion in China. Finally, how to perfect the legal system of preventing and controlling alien species invasion in China is put forward. It is concluded that the prevention and control of invasive alien species requires not only the scientific methods of biology, physics and chemistry, but also, more importantly, the implementation of measures to prevent and control the invasion of alien species at the legal level. Our country should draw lessons from the international advanced legislative experience, renew the legislative idea and clarify the legislative purpose. Secondly, we should make a special law to prevent and control the invasion of alien species, strictly follow the relevant legal principles, and construct and perfect a series of legal systems to prevent and control the invasion of alien species. Thirdly, we should train high-quality law enforcement team and clarify the legal responsibility of relevant responsibility organizations and relevant responsible persons. Finally, it is necessary to define the management organization and management system for preventing and controlling invasive alien species, and set up a unified and coordinated management procedure. The contribution of this paper is not to put forward the innovative theory, but to supplement and apply the existing legal theory and practical method, in order to reach the purpose of the research in this field. It also tries to make up for some deficiencies in this field and to provide some reference and support for the practice of preventing and controlling alien species invasion in China.
