重大环境污染事故受害人救济途径的案例分析

【摘要】：重大环境污染事件近年来不断出现在公众的眼前,其所带来的不单是恶劣的社会影响,更损害了重大环境污染事件受害人的人身和财产权利,造成了巨大的经济、财产损失和难以修复的生态破坏。但是,我国目前对于重大环境污染事故的处理基本上都以解决事件和针对相关责任人的处罚为主,忽略了对于环境污染受害人权利的救济。《侵权责任法》的出台使得环境污染受害人获得了通过民事途径弥补自身损害的权利,但由于缺乏相应的诉讼支持和完善的赔偿执行机制,使得环境污染受害人多数情况下放弃了通过司法途径弥补自身损害。针对目前的状况,亟需完善我国现有的重大环境污染事故受害人的救济途径,以确保在当前的社会、经济环境下,环境污染受害人受损权利恢复的最优化,从而实现环境、经济与社会的和谐发展。基于以上思考,本文运用案例研究法、系统分析法和比较分析法,将理论与实践相结合,从我国三起典型的重大环境污染事件不同的处理方式入手,探求重大环境污染受害人救济的新途径。全文共分为三个部分：第一部分,选取了三起我国影响重大的环境污染事件,对于同类事件不同解决方式的分析,提出案例中涉及的相关法律问题。第二部分,对我国的环境状况加以分析,并探究我国现有法律体系中对环境污染受害人的已有救济模式和不足。第三部分,针对现有模式的不足提出改进意见,说明单靠现有的制度已经不能给予环境污染受害人充分的保障,从而引出环境污染受害人救济的新途径,借鉴国外成熟经验,提出我国建立相关途径可以实施的方向。
[Abstract]:In recent years, major environmental pollution incidents have constantly appeared in the eyes of the public. They have not only brought bad social effects, but also damaged the personal and property rights of victims of major environmental pollution incidents, resulting in a huge economy. In view of the current situation, it is urgent to improve the existing relief channels for the victims of major environmental pollution accidents in China, so as to ensure the optimal restoration of the injured rights of the victims of environmental pollution in the current social and economic environment, thus realizing the environment. Based on the above thinking, this paper uses case study, system analysis and comparative analysis to combine theory with practice, starting with three typical major environmental pollution events in China. To explore a new way for the relief of the victims of major environmental pollution. The paper is divided into three parts: the first part selects three major environmental pollution events in China to analyze the different solutions to similar incidents and put forward the relevant legal issues involved in the case. In the second part, the author analyzes the environmental situation of our country, and probes into the existing relief mode and deficiency of the environmental pollution victims in the existing legal system of our country. The third part, aiming at the deficiency of the existing model, puts forward some suggestions to improve it, which shows that the existing system can no longer give sufficient protection to the victims of environmental pollution, which leads to a new way for the relief of the victims of environmental pollution, and draws lessons from the mature experience of foreign countries. Put forward the direction that our country establishes the relevant way that can be implemented.
