松花江流域水污染防治法律问题研究

【摘要】：松花江是我国七大江河之一,全长1927公里,流域面积约550000平方公里,跨越辽宁、吉林、黑龙江和内蒙古四省区。目前,松花江流域面临流域经济快速增长,水污染物排放量不断加大,水环境质量日益恶化,污染严重等问题,松花江流域水污染形势十分严峻。本文立足于松花江流域水污染防治工作实际,通过对松花江流域水污染防治工作面临主要问题的梳理,在借鉴国外水污染防治特别是流域污染治理方面先进经验的基础上,提出加强松花江流域污水防治工作的具体法律构想,以治理松花江流域水污染问题,从而促进该流域生态系统的良性循环。本文共分五个部分：第一部分是绪论,阐明了研究背景、国内外现状、研究目的和意义；第二部分是我国的水污染防治概况,主要介绍了我国水污染的现状及危害、分别介绍了国内水污染立法、流域水污染立法及松花江流域水污染立法,分析了松花江流域水污染的严重性；第三部分是松花江流域水污染防治存在的问题；第四部分是国外水污染防治立法概况,分别介绍美国、英国、法国、日本等国家的水污染立法概况,以期为完善松花江流域水污染防治立法提供借鉴；第五部分是本文的重点,针对松花江流域水污染防治问题的实际情况,在总结对松花江流域水污染防治工作的基础上提出了具体的立法构想,即在整合现有法律资源的基础上,制定一部统一的《松花江流域水污染防治条例》。该条例主要内容包括基本原则；管理机构设置、生态补偿、公众参与等基本法律制度构建；水污染行为的行政、民事、刑事法律责任完善等。
[Abstract]:Songhua River is one of the seven major rivers in China, with a total length of 1927 kilometers and a basin area of about 550000 square kilometers, spanning four provinces and regions of Liaoning, Jilin, Heilongjiang and Inner Mongolia. At present, the Songhua River basin is faced with the problems of rapid economic growth, increasing discharge of water pollutants, worsening water environment quality and serious pollution, etc. The water pollution situation in the Songhua River basin is very serious. Based on the actual situation of water pollution control in Songhua River Basin, this paper, through combing the main problems in water pollution prevention and control work in Songhua River Basin, draws lessons from the advanced experiences of foreign countries in water pollution prevention and control, especially in watershed pollution control. In order to control the water pollution in Songhua River basin and promote the benign circle of ecosystem, the author puts forward the concrete legal conception of strengthening the sewage prevention and treatment work in Songhua River basin. This paper is divided into five parts: the first part is the introduction, which clarifies the research background, the domestic and foreign present situation, the research goal and the significance, the second part is our country water pollution prevention general situation, mainly introduced our country water pollution present situation and the harm, The domestic water pollution legislation, the basin water pollution legislation and the Songhua river basin water pollution legislation are introduced respectively, and the seriousness of the Songhua river basin water pollution is analyzed, the third part is the existing problems of the Songhua river basin water pollution prevention and control; The fourth part is the foreign water pollution control legislation overview, respectively introduced the United States, Britain, France, Japan and other countries water pollution legislation overview, in order to improve the Songhua River basin water pollution prevention legislation, the fifth part is the focus of this article, In view of the actual situation of water pollution prevention and control in Songhua River basin, this paper puts forward a concrete legislative conception on the basis of summing up the prevention and control work of water pollution in Songhua River basin, that is, on the basis of integrating existing legal resources, Formulate a unified "Songhua River Basin Water pollution Prevention regulations". The main contents of the regulations include the basic principles; the establishment of management institutions, ecological compensation, public participation and other basic legal system construction; the administrative, civil and criminal legal liability improvement of water pollution.
