论我国生产者责任延伸法律制度的完善

【摘要】： 生产者责任延伸制度作为一项全新的废弃物管理制度,是一项环境保护战略。其在防治废弃物污染的作用是明显的。国外已经将该制度很好的付诸于立法和实践中,取得了很好的效果,值得我们借鉴学习。该制度是实现和保障清洁生产顺利实施的必要手段,也是实现循环经济可持续发展的关键步骤。于2008年8月29日通过,并从2009年1月1日起施行的《中华人民共和国循环经济促进法》,在其中的第15条就明确地规定了生产者责任延伸制度。循环经济促进法的出台对我国生产者责任延伸法律制度的建设无疑是一个巨大的促进。我国要在借鉴西方发达国家生产者责任延伸制度实践成功的基础上,结合我国的国情尽快地完善我国的生产者责任延伸法律制度,达到循环利用资源和合理处置废弃物的目的,有效保护我国自然环境与自然资源,进而实现我国经济、社会和生态环境的全面、稳定、持续和健康发展。本文共分为三个部分来论述。第一部分是对生产者责任延伸制度的概述。首先,通过生产者责任延伸制度的起源和发展,对生产者责任延伸制度的内涵进行了探讨,在欧美等国定义的基础上,依据我国国情阐述了本人的观点;其次,对生产者责任延伸制度的主要理论基础——循环经济理论、企业社会责任理论、环境权理论和产品生命周期理论进行了分析;在生产者责任延伸制度里,其主体要素和责任分配的界定是十分重要的,本部分最后论述了生产者、消费者、销售者和政府这四个主体的责任制度。第二部分是对生产者责任延伸法律制度实践的探讨。通过国外生产者责任延伸法律制度的成功实践,主要针对瑞典、德国、美国和日本的成功实践探究:结合我国生产者责任延伸法律制度实施的现状以及生产者责任延伸制度在我国存在的问题的论述,分析了我国生产者责任延伸制度落后的原因。第三部分是完善我国生产者责任延伸法律制度的基本构想。本部分在对完善我国生产者责任延伸法律制度应遵循的基本原则后,结合我国实际对完善我国生产者责任延伸法律制度予以构想,主要从完善相关制度、配套制度方面展开阐述。
[Abstract]:As a brand-new waste management system, the producer responsibility extension system is an environmental protection strategy. Its role in the prevention and control of waste pollution is obvious. The system has been well put into legislation and practice in foreign countries, and it has achieved good results. It is worth learning to learn. This system is to realize and ensure clean production. The necessary means for the smooth implementation is also the key step to realize the sustainable development of the circular economy. In August 29, 2008, the People's Republic of China circular economy promotion law, which was implemented from January 1, 2009, clearly stipulated the extension system of producer responsibility. The circulation economy promotion law was introduced to our country. The construction of the legal system of the extension of the producer's responsibility is undoubtedly a great promotion. On the basis of the success of the practice of the extended producer responsibility system in the western developed countries and combining the national conditions of our country, we should improve the legal system of the extension of the producer responsibility in our country as soon as possible, and achieve the purpose of recycling the resources and disposing of the waste reasonably. Effective protection of our natural environment and natural resources, and then achieve the comprehensive, stable, sustained and healthy development of China's economic, social and ecological environment.
This article is divided into three parts.
The first part is an overview of the extension system of producer responsibility. First, through the origin and development of the producer responsibility extension system, the connotation of the extension system of producer responsibility is discussed. On the basis of the definition of Europe and America and other countries, the author expounds my views on the basis of the national conditions of our country; secondly, the main theory of the extension system of producer responsibility is the main theory. Based on the theory of circular economy, the theory of corporate social responsibility, the theory of environmental rights and the theory of product life cycle, it is very important to define the main elements and responsibility distribution in the extension of producer responsibility. In the end, the responsibility system of the four main bodies, producers, consumers, sellers and governments, is discussed in the end.
The second part is the exploration of the practice of the extension of the legal system of producer responsibility. Through the successful practice of the extended legal system of producer responsibility in foreign countries, it mainly aims at the successful practice of Sweden, Germany, the United States and Japan: the present situation of the implementation of the legal system of the extended producer responsibility in China and the existence of the extension system of producer responsibility in China This paper analyzes the reasons for the backwardness of the producer responsibility extension system in China.
The third part is the basic conception of perfecting the legal system of the extension of producer responsibility in our country. After perfecting the basic principles that should be followed in the legal system of the extension of producer responsibility in our country, this part gives an idea of perfecting the legal system of the extension of producer responsibility in our country.
