我国娱乐动物保护法律问题研究

【摘要】：由于人类“以人为中心”价值观念的盛行,很长一段历史时间内娱乐动物的生存状况并没有引起人类的过多关注。随着动物保护理念进一步升华、动物福利思潮逐渐推广、人类社会文明程度日益提高,娱乐动物的生存状况才渐渐引起了广大公众的关注。世界上有许多国家已经制定了动物保护、动物福利、防止虐待动物等方面的立法,其中有专门条款规定了对娱乐动物的保护。相反,我国动物保护事业起步较晚,相关的法律法规相对欠缺,对娱乐动物的立法保护更是微乎其微。本课题研究的目的旨在通过对目前我国娱乐动物生存状况的分析,探讨现有法律制度下对娱乐动物保护存在的诸多问题,并在借鉴国内外先进立法和实践经验基础之上,提出适合我国娱乐动物保护的解决对策,为我国今后的娱乐动物保护事业发展提供切实可行的参考。 本文通过对动物保护及动物福利内涵的研究,阐述了从法律角度对娱乐动物的界定,并对其特点和分类进行分析,为下文的系统研究做理论上的铺垫。在搜集大量针对娱乐动物及娱乐动物经营场所的调查报告后,运用一系列数字、图表总结现阶段我国的娱乐动物生存现状,并且通过查阅我国现有法律法规,整理出我国涉及娱乐动物保护的有关规定。通过对娱乐动物生存现状及我国有关娱乐动物保护的立法现状分析,揭示出我国立法及法律制度层面存在的问题,正是由于这些问题的存在才使得我国娱乐动物的状况令人担忧。针对这些问题,本文在借鉴国外先进娱乐动物立法及实践经验基础上,从完善法律体系、规范法律责任、健全法律制度等三个方面提出具体的解决对策。通过本课题的研究,希望对我国娱乐动物保护立法工作的开展起到进一步推动作用。
[Abstract]:Because of the popularity of human "centred" values, the existence of entertainment animals in a long period of time has not aroused much attention. With the further promotion of the concept of animal protection, the trend of animal welfare is gradually popularized and the degree of civilization of human society is increasing, and the living conditions of entertainment animals have gradually been caused. The public is concerned. There are many countries in the world that have enacted legislation on animal protection, animal welfare, and prevention of cruelty to animals. There are special provisions which stipulate the protection of entertaining animals. On the contrary, China's animal protection is relatively late, relative laws and regulations are relatively deficient, and the legislative protection for entertaining animals is slightly less. The purpose of this study is to discuss the existing problems in the protection of entertainments under the existing legal system, and on the basis of the advanced legislation and practice experience at home and abroad on the basis of the domestic and foreign advanced legislation and practical experience, and put forward the solutions for the entertainment animal protection in our country, for the future entertainment of our country. It provides a practical reference for the development of animal protection.
Through the study of the connotation of animal protection and animal welfare, this paper expounds the definition of recreational animals from the legal point of view, analyzes their characteristics and classifications, and makes theoretical paving for the systematic research below. After collecting a large number of investigation reports on entertainment animals and entertainment animals, a series of figures and graphs are used. The present situation of the existence of entertainment animals in our country is summarized, and the relevant regulations concerning the protection of recreational animals in our country are arranged through consulting the existing laws and regulations in our country. Through the analysis of the present situation of the survival of the entertainments and the legislative status of the protection of entertainment animals in our country, the problems in the legislative and legal systems of our country are revealed. Because of the existence of these problems, the situation of our country's entertaining animals is worrying. In view of these problems, this paper puts forward specific solutions from three aspects, including perfecting the legal system, standardizing legal responsibility and perfecting the legal system on the basis of foreign advanced entertainment animal legislation and practice experience. It will play a further role in promoting the legislation of entertainment animal protection in China.
