【摘要】： 环境侵权是因人为活动导致环境污染或生态破坏,进而危害他人的人身权、财产权和环境权的特殊侵权行为。与一般侵权行为相比,环境侵权具有受害人多、造成损害大、侵权人难以认定等特点。环境侵权事故发生后,及时、有效的救济受害人与保障企业的持续发展是现行环境侵权损害赔偿制度面临的两难问题。论文以企业和受害人的双方利益平衡为出发点,在考量现行制度和考察国外实践的基础上,提出环境侵权损害赔偿责任社会化的制度方式,并对社会化赔偿的具体制度设计提出一些个人观点。论文共分六个部分:引言部分阐述了选题的由来、背景、研究目的、意义和方法。第一章从环境侵权的特殊性出发,分析了现有环境侵权损害赔偿制度的不足,提出了环境侵权赔偿责任社会化制度及该制度的具体实施方式,并分析了在我国建立环境侵权赔偿责任社会化制度的必要性。第二章重点分析了环境侵权赔偿责任社会化的两大基础:社会基础和法律基础。其中,环境侵权赔偿责任社会化的社会基础包括经济与科技的发展、责任保险的发展;法律基础包括社会本位观的确立、公平正义观的发展和无过错责任的确立。第三章重点介绍国外及国际社会环境侵权赔偿责任社会化制度的实施经验,通过对各种经验的比较分析,得到适合我国可以借鉴的制度方式和制度设计时应注意的问题。第四章阐述了环境侵权赔偿责任社会化的两大具体制度:环境责任保险和环境侵权损害赔偿基金。通过对两种制度在我国设立的可行性分析,同时考虑到我国保险业和基金业的现状,设计两种制度主要的、具体的内容。另外,对环境责任保险和环境侵权损害赔偿基金在我国顺利开展的社会条件提出部分建议。结论部分通过对论文进行总结,认为目前我国的环境侵权赔偿现状需要在这一领域实现责任的社会化,同时我国的保险业与基金业的现状也具备了承担环境侵权赔偿责任的能力。因此,我国可以也应该建立环境责任保险制度和环境侵权损害赔偿基金制度。
[Abstract]:Environmental tort is a special tort that causes environmental pollution or ecological destruction by human activities, thereby endangering the personal rights, property rights and environmental rights of others. Compared with the general tort, environmental tort has the characteristics of more victims, more damage and more difficult to identify the infringer. After the environmental tort accident happens, timely and effective relief to the victim and the sustainable development of the enterprise are the dilemmas faced by the current environmental tort compensation system. Based on the balance between the interests of the enterprise and the victim, and on the basis of considering the current system and investigating the foreign practice, the paper puts forward the system of socialization of liability for compensation for environmental tort damage. And the specific system design of social compensation put forward some personal views. The paper is divided into six parts: the introduction describes the origin, background, research purpose, significance and methods. In the first chapter, from the particularity of environmental tort, it analyzes the deficiency of the existing environmental tort compensation system, and puts forward the socialization system of environmental tort compensation liability and the concrete implementation mode of this system. It also analyzes the necessity of establishing socialized system of compensation liability for environmental tort in China. The second chapter analyzes the two foundations of the socialization of environmental tort liability: social basis and legal basis. The social foundation of the socialization of environmental tort liability includes the development of economy and technology, the development of liability insurance, the establishment of social standard, the development of fairness and justice, and the establishment of no-fault liability. The third chapter focuses on the implementation experience of the socialization system of environmental tort liability in foreign countries and the international community. Through the comparative analysis of various experiences, the author obtains the system methods and problems that should be paid attention to when we can use for reference in our country. Chapter four expounds two specific systems of socialization of environmental tort liability: environmental liability insurance and environmental tort compensation fund. By analyzing the feasibility of the establishment of the two systems in China and considering the current situation of insurance and fund industry in China, the main and specific contents of the two systems are designed. In addition, some suggestions on the social conditions of environmental liability insurance and environmental tort compensation fund in China are put forward. In conclusion, the author concludes that the present situation of environmental tort compensation in China needs to be socialized in this field. At the same time, the current situation of insurance and fund industry in China also has the ability to assume liability for environmental tort. Therefore, China can and should establish environmental liability insurance system and environmental tort compensation fund system.
