【摘要】： 我国海洋经济自二十世纪世纪八十年代以年平均l7%的速度增长。90年代以年平均20%的速度递增。到2000年海洋产业产值将达到5000亿元左右,海洋经济的增长速度仍可保持在20%左右。海洋经济成为国家经济的重要组成部分。海洋功能区划制度是我国海域使用管理的一项基本制度。自1988年我国政府首次提出把海洋功能区划作为一项海洋管理的基础性工作开展至今,海洋功能区划经历了大约二十多年的时间。在这期间,海洋功能区划制度对保护海洋环境,调整海洋开发利用活动,遏制海域使用的“三无”现象发挥了重要作用。但是我国海洋环境质量状况仍然不容乐观,这固然与我国海洋经济发展速度快有关,然而这也反映了我国海域管理制度的落后,作为我国海域使用管理基本制度的海洋功能区划制度存在着一些诸如区划编制水平不高,区划被批准后频频修改,区划得不到严格实施之类的问题,这些问题的存在使得海洋功能区划制度的无法发挥它应用的作用。本文通过研究海洋功能区划制度的理论,了解我国海洋环境质量状况和海域开发利用状况,以及我国海洋功能区划制度的实践,肯定了海洋功能区划制度在海域使用管理中的积极作用,并强调海洋功能区划制度在海域使用管理制度中的重要地位;借鉴国外海洋分区管理的法律实践,以制度经济学派的框架寻找和分析我国海洋功能区划制度中存在的问题;最后以此为基础,就如何完善我国的海洋功能区划制度提出个人的看法和建议,以达到推动我国海域使用管理制度完善的目的。
[Abstract]:China's marine economy has increased from an average of l7% at an annual average of l7% in the year 80s of the twentieth Century century with an annual average of 20% in the.90 years. By 2000, the output value of the marine industry will reach about 500 billion yuan, and the growth rate of the marine economy can still remain around 20%. The system is a basic system for the use and management of sea area in China. Since 1988, our government first proposed that the marine functional zoning has been carried out as a basic work of marine management, and the marine functional zoning has gone through about more than 20 years. During this period, the marine functional zoning system has been used to protect the marine environment and adjust the marine development. It has played an important role in the use of activities to contain the "three non" phenomena used in the sea area. However, the quality of the marine environment in our country is still not optimistic, which is of course related to the rapid development of China's marine economy. However, it also reflects the backwardness of the sea area management system in our country and the marine functional zoning as the basic system for the management of the sea area in our country. There are some problems in the system, such as the low level of regionalization, the revision of the zoning and the no strict implementation of the division. The existence of these problems makes the marine functional regionalization system unable to play its role. This paper studies the theory of the marine functional zoning system and understands the quality of the marine environment in China. As well as the development and utilization of sea area and the practice of marine functional zoning system in China, the positive role of the marine functional zoning system in the management of sea area is affirmed, and the important position of the marine functional zoning system in the management system of sea area is emphasized, and the legal practice of the management of the marine sub area in foreign countries is used for reference to the frame of the institutional economics school. To find out and analyze the problems in the system of marine functional zoning in China, on the basis of this, the author puts forward personal views and suggestions on how to perfect the system of marine functional zoning in China so as to achieve the purpose of improving the management system for the use of sea areas in our country.
