森林生态效益补偿主要原则研究

【摘要】：森林作为陆地生态系统中最重要的主体之一,兼具生态效益和经济效益两大方面。但由于长期以来,我国对森林生态效益认识的局限性,过度追求其经济效益,而忽视了其生态效益的实现。国家为了保护和维持我国的森林资源,将森林中的一部分林区划分为生态公益林,禁止砍伐滥用。但与此同时,缺乏对因保护森林的生态效益而受到经济损失的生态公益林所有者提供经济补偿的有效机制,因而,无法在生态效益的保护者和受益者之间建立有效的利益平衡。在此基础上,我国亟需建立完善的森林生态效益补偿机制并应首先确立森林生态效益补偿的主要原则。本文从森林生态效益补偿的内涵界定入手,概括了森林生态效益补偿的立法现状和法理基础,通过对国外森林生态效益补偿立法及实践的论述,对我国森林生态效益补偿主要原则的确定进行比较借鉴,明确指出我国森林生态效益补偿应确立的主要原则为森林生态效益补偿的公平原则、政府主导和市场化相结合原则和受益者付费原则。
[Abstract]:As one of the most important subjects in terrestrial ecosystem, forest has both ecological and economic benefits. However, because of the limitation of our country's understanding of forest ecological benefits for a long time, the realization of forest ecological benefits has been neglected because of the excessive pursuit of its economic benefits. In order to protect and maintain the forest resources of our country, some forest areas in our country are divided into ecological public welfare forests and the abuse of deforestation is prohibited. But at the same time, there is a lack of effective mechanism to provide economic compensation to the owners of ecological public forests who suffer economic losses due to the ecological benefits of forest protection, so it is impossible to establish an effective balance of interests between the protectors and beneficiaries of ecological benefits. On this basis, our country urgently needs to establish the perfect forest ecological benefit compensation mechanism and should first establish the main principle of the forest ecological benefit compensation. Starting with the definition of forest ecological benefit compensation, this paper summarizes the legislative status and legal basis of forest ecological benefit compensation, and discusses the legislation and practice of forest ecological benefit compensation abroad. By comparing the main principles of forest ecological benefit compensation in China, it is pointed out that the main principle of forest ecological benefit compensation in China should be the fair principle of forest ecological benefit compensation. Government-led and market-oriented combined principle and beneficiary payment principle.
