“限塑令”的法理学思考

【摘要】：我国力图通过"限塑令"来引导与规范公众的环保意识与资源循环意识,但效果并不如预期。由于对"限塑令"的合理性和有效性等的理解和认识存在诸多偏差,其执行可能导致较高的社会成本。惩罚性罚款的适用也面临着选择性执法以及机会成本的问题。相比较生硬的政策法规,以软性的增强民众环保自觉性教育无疑是新型的路径选择。同时现阶段替代品的使用也要坚持减量化、再使用、再循环的原则,只有从源头使用上减量,才是解决问题的首要所在。最后逐渐以软性的增强民众环保自觉性教育来替代生硬的政策法令。
[Abstract]:Our country tries hard to guide and standardize the public's consciousness of environmental protection and resource circulation through "limited plastic order", but the effect is not as expected. There are many deviations in understanding and understanding of rationality and validity of plastic restraint order, which may lead to higher social cost. The application of punitive penalty also faces the problem of selective enforcement and opportunity cost. Compared with stiff policies and regulations, it is undoubtedly a new path choice to strengthen the environmental consciousness education of the people. At the same time, the principle of reducing, reusing and recycling should be adhered to in the use of alternatives at this stage. Only by reducing the amount from the source is the most important thing to solve the problem. Finally, the soft education to strengthen the environmental awareness of the public to replace the rigid policy.
