【摘要】： 21世纪,如何运用刑法来遏制环境职务犯罪已经成为亟待解决的重大问题之一,关系到是关系到我国实施可持续发展战略、构建社会主义和谐社会的重要问题。本文着眼于矿产资源刑事立法的进一步完善,重点论述了环境职务犯罪刑事立法完善的方向及其具体要件设计。本文绪论部分,简要介绍了课题的国内外研究现状以及理论和实践意义。本文首先界定了环境职务犯罪的内涵、特点和分类,明确了本文的研究对象。其次,文章对我国环境职务犯罪的刑事立法现状展开分析,介绍和分析了我国环境职务犯罪的立法现状,并且着重从犯罪构成的角度对刑法中的规范进行了分析。第三,文章从演绎归纳的逻辑思路,运用实证分析、比较分析等方法阐述了我国环境职务犯罪的两类犯罪分别在罪名方面的缺陷；而且对我国环境职务犯罪主体范围不明确和偏窄的缺陷进行了分析；同时在刑罚方面从环境职务犯罪量刑较轻和刑罚种类单一两个方面进行了论述。第四,文章对国外环境职务犯罪立法概况进行分析,结合我国司法实际情况加以借鉴,汲取西班牙等国对主体范围的扩大化的规定；吸收俄罗斯、芬兰、瑞典等国在刑罚种类的多样化规定,引入资格刑、劳役刑和罚金刑。最后文章结合我国实际提出我国环境职务犯罪立法完善的对策。一是增设四项罪名相关罪名。一方面对污染环境类职务犯罪增设水资源监管失职罪；另一方面对破坏自然资源保护类环境职务犯罪增设违法发放矿产资源开采许可证罪、草原资源监管失职罪非法批准和征用草原资源罪。二是提高环境职务犯罪的法定刑配置,以更好的遏制环境职务犯罪。
[Abstract]:In the 21st century, how to use criminal law to curb environmental crime has become one of the important problems to be solved, which is related to the implementation of sustainable development strategy and the construction of a harmonious socialist society. This paper focuses on the further improvement of criminal legislation on mineral resources, and discusses the direction of perfection of criminal legislation of environmental duty crime and the design of its specific elements. In the introduction part, this paper briefly introduces the current research situation and the theoretical and practical significance of the subject at home and abroad. Firstly, this paper defines the connotation, characteristics and classification of environmental duty crime, and clarifies the research object of this paper. Secondly, the article analyzes the present situation of criminal legislation of environmental duty crime in China, introduces and analyzes the present legislation situation of environmental duty crime in our country, and emphatically analyzes the norms in criminal law from the angle of constitution of crime. Third, the article from deductive inductive logic thinking, using empirical analysis, comparative analysis and other methods to explain the two types of environmental duty crime in charge of the defects; Moreover, this paper analyzes the defects of the unclear and narrow scope of the subject of environmental duty crime in our country, and discusses the penalty from two aspects: the lighter sentencing of environmental duty crime and the single type of punishment. Fourth, the article analyzes the general situation of foreign environmental duty crime legislation, combines with the actual situation of our country to draw lessons from the Spanish and other countries to expand the scope of the provisions of the subject; absorb Russia, Finland, Sweden and other countries have introduced qualification penalty, servitude penalty and fine penalty in the diversification of penalty types. Finally, the article puts forward the countermeasures to perfect the legislation of environmental duty crime in our country. One is to add four charges related to the charges. On the one hand, the crime of dereliction of duty in the supervision of water resources is added to the duty crime of polluting the environment; The crime of illegal approval and expropriation of grassland resources. Second, improve the legal punishment allocation of environmental duty crime, in order to better curb environmental duty crime.
