【摘要】：排污权交易制度作为一项解决环境问题的经济法律制度,已逐渐成为世界许多国家的制度选择,尤其是一些发达国家的排污权交易制度日趋成熟,有关排污权交易制度的研究也颇为丰富,这对我国排污权交易制度的研究提供了深厚的理论基础和实践经验。然而我国在排污权交易实践中发现用某些发达国家的研究成果来解决中国的环境问题存在一些困难。中国是一个人口众多、地域辽阔、利益关系更加复杂的国家,在排污权交易制度中,一定区域的政府机关、环保部门、形形色色的企业以及与环境质量息息相关的居民群体之间的各种利益关系突显,显然,协调好这些主体之间的利益关系不仅有利于我国排污权交易工作的顺利开展,更能适应低碳经济和循环经济的发展要求,实现可持续发展目标。本文正是在这样的背景下,首次从排污权交易制度主体利益关系的角度进行系统研究。论文的研究对象是排污权交易制度中的主体利益关系,研究目的是针对当前排污权交易实践中存在的分配、交易等方面的问题,从主体利益的角度分析并提出解决方法和思路。文中坚持理论和实际相结合的原则,将排污权交易制度中的主体分为交易主体和参与主体两类,对主体之间存在利益冲突的原因及表现进行分析,最后从宏观和微观两方面构思主体利益冲突关系获求平衡的路径,主要内容概述如下: 第一部分,提出本文的研究主题、研究意义、国内外有关排污权交易的研究现状以及本文的研究内容与思路; 第二部分,将排污权交易制度中的主体进行分类,并就分类依据简要阐释,本章内容是全文的写作前提,为后文的写作奠定基础; 第三部分,结合理论与实践,分析排污权交易制度中各主体之间的利益冲突关系,并对利益冲突的原因、表现及不良性作详细的探讨; 第四部分,从社会、环境和经济三方面对排污权交易制度中各主体利益关系获求平衡的价值进行考量,在文中具有承上启下的作用; 最后,在上述分析的基础上,从宏观和微观两方面来寻求排污权交易制度中主体利益关系获求平衡的路径。
[Abstract]:As an economic legal system to solve environmental problems, emission trading system has gradually become the system choice of many countries in the world, especially in some developed countries. The research on emission trading system is also very rich, which provides a profound theoretical basis and practical experience for the study of emission trading system in China. However, in the practice of emission trading, it is found that there are some difficulties in solving China's environmental problems with the research results of some developed countries. China is a country with a large population, a vast territory, and a more complicated interest relationship. In the emissions trading system, government agencies and environmental protection departments in certain regions, Various kinds of interest relations between various enterprises and residents who are closely related to environmental quality are highlighted. Obviously, coordinating the interest relations among these subjects is not only conducive to the smooth development of emission trading in China. More can adapt to the development requirements of low-carbon economy and circular economy, achieve the goal of sustainable development. Under this background, this paper makes a systematic study from the angle of the main interests of the emission trading system for the first time. The object of this paper is the relationship of the subject interests in the emission trading system. The purpose of the study is to analyze and put forward the solutions from the angle of the subject interests in view of the distribution and trading problems existing in the current emission trading practice. In this paper, we insist on the principle of combining theory with practice, and divide the main body of emission trading system into two types: trading subject and participating subject, and analyze the cause and performance of the conflict of interest between the main bodies. At last, the author conceive the way of balancing the conflict of interest relationship between the subject from the macro and micro aspects. The main contents are summarized as follows: the first part, put forward the research theme of this paper, the significance of the study, The current situation of domestic and foreign research on emission trading and the contents and ideas of this paper. The second part classifies the subjects in the emission trading system and briefly explains the classification basis. The content of this chapter is the premise of the full text, which lays the foundation for the later writing. The third part, combined with the theory and practice, analyzes the conflict of interest between the main parties in the emission trading system, and analyzes the reasons for the conflict of interest. The fourth part, from the social, environmental and economic aspects of the emission trading system in the interests of the main interests of the value of balance, Finally, on the basis of the above analysis, we seek the path of balancing the main body's interest relationship in the emission trading system from the macro and micro aspects.
