集体生态公益林法律制度研究

【摘要】：《中共中央国务院关于加快林业发展的决定》(2003年6月25日)提出将森林区分为公益林和商品林两类。实行分类区划后,一部分集体林被区划为商品林,逐步放开进行市场化经营；一部分集体林被区划为公益林,严格控制其开发利用。由此,在集体生态公益林建设中出现了一些问题,具体表现在：(1)林权证发放不落实,集体生态公益林的林木处置权受到严格限制；(2)森林分类区划不完善；(3)集体生态公益林政策法规不健全,致使集体生态公益林得不到有效保护；(4)集体生态公益林补偿和管护资金难保证,导致农民权益受损,积极性不高等。集体森林、林木、林地是农民赖以生存和发展的根本。如果农民没有积极性,那么集体生态公益林建设的目标就会落空。外部性理论、公益理论、激励理论以及可持续发展理论是解决公益私益平衡问题的理论基础。集体生态公益林具有其特殊性,对其保护十分必要。针对集体公益林建设中存在的问题,我国应当健全集体生态公益林法律制度。首先,要在《森林法》中确立集体生态公益林建设的法律地位；其次,建立集体生态公益林的区划,规划,确权,认证以及分类经营制度；再次,从衡平集体生态公益林的公益与私益的角度建立集体生态公益林社区共管制度与林地地役权制度；最后,建立集体公益林建设资金保障制度与生态效益补偿制度,以保障集体生态公益林的可持续发展。
[Abstract]:The decision of the CPC Central Committee and the State Council on speeding up the Development of Forestry (June 25, 2003) proposed to divide the forest into two categories: public welfare forest and commercial forest. After classified division, a part of collective forest is divided into commercial forest, and a part of collective forest is divided into public welfare forest, and its development and utilization are strictly controlled. As a result, there are some problems in the construction of collective ecological public welfare forest, which are as follows: (1) the issuance of forest right certificate is not carried out, the right to deal with the forest of collective ecological public welfare forest is strictly restricted; (2) the forest classification and regionalization is not perfect; (3) the policies and regulations of collective ecological public welfare forest are not perfect, resulting in collective ecological public welfare forest can not be effectively protected; (4) the collective ecological public welfare forest compensation and management funds are difficult to ensure, resulting in farmers' rights and interests are damaged, enthusiasm is not high, etc. Collective forests, trees and woodlands are the basis for farmers' survival and development. If the farmer does not have enthusiasm, then collective ecological public welfare forest construction goal will be defeated. Externality theory, public welfare theory, incentive theory and sustainable development theory are the theoretical basis to solve the problem of public benefit balance. Collective ecological public welfare forest has its particularity, so it is necessary to protect it. In view of the problems existing in the construction of collective public welfare forest, our country should perfect the legal system of collective ecological public welfare forest. First, to establish the legal status of the construction of collective ecological public welfare forest in the Forest Law; secondly, to establish the division, planning, confirmation, certification and classified management system of collective ecological public welfare forest; third, From the perspective of balancing the public welfare and private interests of the collective ecological public welfare forest, this paper establishes the community management system and the forest easement system of the collective ecological public welfare forest, and finally, establishes the collective public welfare forest construction fund security system and the ecological benefit compensation system, and establishes the collective ecological public welfare forest community management system and the forest land easement system. In order to ensure the sustainable development of collective ecological public welfare forest.
