论我国农业固体废物污染法律规制的完善

【摘要】：近年来，随着我国农村经济的不断发展，农村环境污染状况越来越严重，其中，农业固体废物污染不容忽视，对此，国家也予以了重视，在财政资金投入方面，自2010年起，中央财政将在未来三年安排专项资金120亿元，重点支持农村环境污染综合整治，其中便包含农业固体废物综合利用与污染防治。在法律规制方面，健全的法制是农业固体废物污染防治的重要保障。农业固体废物污染越来越严重，为此，我国已颁布了一些与农业固体废物污染防治有关的法律规范，使我国农业的固体废物污染防治有一定的法律依据，农业固体废物污染防治也取得了一些成效，但是，考察我国农业固体废物污染状况及相关法律规范的实施情况，这一领域的立法严重滞后于社会经济发展的要求，目前我国的农业固体废物污染法律规制仍不够完善。研究和完善我国农业固体废物污染的法律规制对于完善我国整个环境保护法律体系，保护农村环境具有十分重要的意义。本文首先从考察我国农业固体废物污染防治的立法现状入手，从法理的角度对现行立法的功能作用和实施效果两方面进行了评价分析，指出我国农业固体废物污染防治立法并未达到理想的实施效果。其次，详细论述了目前我国的农业固体废物污染法律规制仍存在的问题及其原因。最后，本文针对现行农业固体废物污染法律规制存在的问题，结合国外农业固体废物污染防治立法的先进经验，对我国农业固体废物污染法律规制的完善，提出如下建议：第一，更新农业固体废物污染防治立法理念，贯彻可持续发展理念；第二，选择符合我国国情的立法模式，即综合性立法与单行法相结合的模式；第三，具体立法建议包括：进行综合性农业固体废物循环利用与污染防治立法，提高立法层次；制定专门的单行法，，填补目前的立法空白，并将现行法律法规中不适宜的内容进行修正；增加经济激励性的规定，充分调动各方面的积极性；逐步建立农业固体废物污染监测体系，完善环境保护标准，健全农业固体废物循环利用的技术推广体系；明确规定政府的职责与责任；完善公众参与立法。通过对上述几方面的完善，最终构建一个适合我国国情的完备而协调的农业固体废物污染防治法律体系。
[Abstract]:In recent years, with the continuous development of rural economy in our country, the situation of environmental pollution in rural areas is becoming more and more serious, among which, the pollution of agricultural solid waste can not be ignored. The central government will allocate 12 billion yuan in special funds in the next three years to focus on supporting comprehensive control of environmental pollution in rural areas, which includes comprehensive utilization of agricultural solid waste and pollution prevention and control. In the aspect of legal regulation, sound legal system is an important guarantee for the prevention and control of agricultural solid waste pollution. The pollution of agricultural solid waste is becoming more and more serious. For this reason, China has promulgated some legal norms related to the prevention and control of agricultural solid waste pollution, which makes the prevention and control of agricultural solid waste pollution have certain legal basis. Some achievements have also been made in the prevention and control of agricultural solid waste pollution. However, the legislation in this field lags behind the requirements of social and economic development after investigating the situation of agricultural solid waste pollution and the implementation of relevant legal norms in China. At present, the legal regulation of agricultural solid waste pollution in our country is still not perfect. It is of great significance to study and perfect the legal regulation of agricultural solid waste pollution in China for perfecting the whole legal system of environmental protection and protecting the rural environment. In this paper, first of all, the current situation of legislation on the prevention and control of agricultural solid waste pollution is reviewed, and the function and effect of the current legislation are evaluated and analyzed from the perspective of legal theory. It is pointed out that the legislation on the prevention and control of agricultural solid waste pollution has not achieved the ideal effect. Secondly, the problems and causes of the legal regulation of agricultural solid waste pollution in China are discussed in detail. Finally, in view of the existing problems in the legal regulation of agricultural solid waste pollution, combined with the advanced experience of foreign agricultural solid waste pollution prevention and control legislation, this paper improves the legal regulation of agricultural solid waste pollution in China. Put forward the following suggestions: first, update the agricultural solid waste pollution prevention legislation concept, implement the concept of sustainable development; second, select a legislative model in line with the national conditions of our country, that is, comprehensive legislation combined with a single law; third, Specific legislative proposals include: comprehensive legislation on the recycling of agricultural solid waste and pollution prevention and control, to raise the legislative level; to develop a special law to fill in the current legislative gaps, It also amended the unsuitable contents of the existing laws and regulations, increased the provisions of economic incentives, fully aroused the enthusiasm of all sides, gradually established a monitoring system for the pollution of agricultural solid wastes, and perfected the environmental protection standards, Improve the technical extension system of agricultural solid waste recycling; clearly define the responsibilities and responsibilities of the government; improve public participation in legislation. Finally, a complete and coordinated legal system for the prevention and control of agricultural solid waste pollution is constructed through the improvement of the above mentioned aspects.
