论鄱阳湖湿地生态环境的法律保护

【摘要】： 鄱阳湖是中国最大的淡水湖,湖区生态环境优美,水产生物丰富多样,已经是国内不再多见、面积较广、人与自然共处相对和谐的生态典范。但近年来,随着经济的发展,人口的增长,湖泊的生态危机和压力也在增加,特别是近30年来我国众多淡水湖生态屡屡告急,拯救湖泊生命的呼声由此而起。在我国目前尚缺乏全国性湿地保护专项立法的前提下,从法律的角度来保护鄱阳湖湿地,显得尤为迫切。本论文以保护鄱阳湖湿地为宗旨,从法律的角度提出了对鄱阳湖湿地保护的完善建议。论文的第一部分是引言,主要介绍鄱阳湖湿地的基本情况、研究背景、目的和意义;论文的第二部分是对鄱阳湖湿地的概述,介绍湿地、鄱阳湖湿地等基本概念,分析了鄱阳湖湿地的基本特征和主要功能,总结归纳出鄱阳湖湿地生态环境存在的主要问题并针对这些问题进行了原因分析;论文的第三部分对鄱阳湖湿地生态环境保护立法现状及存在的问题进行了论述,通过再现《江西省鄱阳湖湿地保护条例》的制定背景和制定过程,评价条例的历史地位和现实作用,归纳出鄱阳湖湿地生态环境保护立法存在全国性湿地专项保护法律空白、管理体制不完善和法律操作性不强等问题;从履行国际义务、完善江西乃至我国生态环境保护立法体系和维护生态安全,实现可持续发展的角度来分析完善鄱阳湖湿地生态环境保护法律的必要性;第四部分是论文的重点部分,主要是对鄱阳湖湿地保护提出了五点完善建议。第一是法律制度的完善,包括鄱阳湖湿地利用许可管制制度、生态效益补偿制度、公众参与制度和鄱阳湖湿地的权属制度等四个方面的完善;第二,笔者认为应当完善鄱阳湖湿地的管理体制,对鄱阳湖进行流域综合管理,理顺鄱阳湖湿地管理机构,应建立自然保护与社区协调发展的机制,实行鄱阳湖区域开发管制制度。第三,论文从处罚主体和处罚办法等方面论述了法律责任的完善。第四,笔者建议建立健全和完善鄱阳湖湿地保护的法规和规章制度,在认真实施现有法律法规的基础上,尽快制定全省专门的湿地保护与利用的法规,以法规形式明确规定鄱阳湖湿地开发利用的方针、原则、行为规范、部门分工以及对违法行为处罚等。最后,文章呼吁要树立湿地生态环境法律理念,加强环境宣传教育,充分发挥社会监督和公众参与的作用,保护鄱阳湖这一盆清水,实现人与湖的和谐共处。本文针对鄱阳湖湿地保护相关的法律法规滞后及存在的各种各样的不足,在调查研究的基础上,参考借鉴国内外湿地保护研究的成功经验,从法律制度的完善、管理体制的构建等方面提出了鄱阳湖湿地立法完善的建议,对鄱阳湖湿地的保护工作具有一定的理论指导意义和现实意义。
[Abstract]:Poyang Lake is the largest freshwater lake in China. It has a beautiful ecological environment rich in aquatic organisms and has become an ecological model of relatively harmonious coexistence between man and nature. But in recent years, with the development of economy and population growth, the ecological crisis and pressure of lakes are also increasing. Under the premise of lack of national special legislation on wetland protection in China, it is urgent to protect Poyang Lake wetland from the angle of law. The purpose of this paper is to protect Poyang Lake wetland, from the point of view of law, the paper puts forward some suggestions to improve the protection of Poyang Lake wetland. The first part of the paper is the introduction, mainly introduces the basic situation, the research background, the purpose and the significance of the Poyang Lake wetland; the second part of the paper is an overview of the Poyang Lake wetland, the introduction of the basic concepts of the wetland, Poyang Lake wetland, etc. This paper analyzes the basic characteristics and main functions of Poyang Lake wetland, summarizes the main problems existing in the ecological environment of Poyang Lake wetland, and analyzes the reasons for these problems. In the third part of the paper, the current situation and existing problems of the legislation on ecological environment protection of Poyang Lake wetland are discussed, and the background and process of making the regulations on wetland protection of Poyang Lake in Jiangxi Province are reappeared. To evaluate the historical status and practical role of the regulations, it is concluded that the legislation on ecological environment protection of Poyang Lake wetland has some problems, such as national special protection law blank, imperfect management system and weak legal maneuverability, etc., in order to fulfill the international obligations, From the angle of perfecting the legislative system of ecological environment protection and maintaining ecological security and realizing sustainable development in Jiangxi and China, the necessity of perfecting the ecological environment protection law of Poyang Lake wetland is analyzed. The fourth part is the key part of the thesis. The paper puts forward five suggestions for the protection of Poyang Lake wetland. The first is the perfection of the legal system, including the regulation of the use of the Poyang Lake wetland, the ecological benefit compensation system, the public participation system and the ownership system of the Poyang Lake wetland. The author thinks that the management system of Poyang Lake wetland should be perfected, the basin comprehensive management of Poyang Lake should be carried out, the management organization of Poyang Lake wetland should be straightened out, the mechanism of harmonious development of nature protection and community should be established, and the system of regional development and control of Poyang Lake should be implemented. Third, the thesis discusses the perfection of legal liability from the aspects of punishment subject and punishment method. Fourthly, the author suggests that the regulations and rules for the protection of Poyang Lake wetland should be established and perfected, and on the basis of implementing existing laws and regulations seriously, the laws and regulations on the protection and utilization of wetlands in the whole province should be formulated as soon as possible. In the form of laws and regulations, the policies, principles, codes of conduct, division of labor and punishment for illegal acts are clearly stipulated. Finally, the article calls for setting up the legal concept of wetland ecological environment, strengthening environmental propaganda and education, giving full play to the role of social supervision and public participation, protecting Poyang Lake as a basin of clear water, and realizing harmonious coexistence between people and lakes. In view of the lag of laws and regulations related to the protection of Poyang Lake wetland and its various shortcomings, this paper, on the basis of investigation and research, refers to the successful experience of wetland protection research at home and abroad, and from the perfection of legal system, Some suggestions on how to perfect the legislation of Poyang Lake wetland are put forward in the aspects of management system, which is of theoretical and practical significance to the protection of Poyang Lake wetland.
