论我国民事环境纠纷行政处理机制的完善

【摘要】:工业革命以来,世界经济发生了翻天覆地的变化,但在经济不断迅猛发展的同时,环境问题也开始大量涌现。人类的生存发展永远不能脱离开环境的约束,它关系到每一个国家每一个民族的发展。而经济的发展伴随的就是对环境、资源的开发利用,在这个过程中就会出现大量的环境纠纷。而这些纠纷中环境民事纠纷是数量最多的,它不仅对人们的生命财产构成巨大的损害和威胁,更会对环境造成巨大的污染,所以如何解决环境民事纠纷就成了所有国家和地区都要面对的重大问题。世界各国各地区都在不断摸索解决这一纠纷的机制方法,在这一过程中作出了大量的理论研究和实践探索。在不断的实践中发现环境民事纠纷行政处理机制是较为可取的一种解决机制。 广义上讲,解决纠纷的机制可划分为两种,一是诉讼方式,二是非诉讼方式。对于环境纠纷而言,诉讼方式成本较高,而且专业性不强;非诉讼方式主要就是行政解决这一方式。本文主要介绍环境民事纠纷的行政处理机制,笔者主要从四个方面进行论述。首先是环境民事纠纷行政处理机制概述,在这一部分主要论述了基本概念如环境民事纠纷和环境民事纠纷行政处理,这些基本概念就成为全文的理论基础。其次是我国现有的环境民事纠纷行政处理概况,笔者着重分析了现有的几种解决方式如行政调解、行政裁决和行政仲裁,但需要注意的是在我国实践中,这三种行政处理方式都没有取得应有的效果,这其中的问题是多方面的,笔者在这一部分中作出了详细的论述。第三部分中,笔者介绍了域外国家和地区包括我国台湾地区的经验教训,动态机制和静态立法,从中总结出适合我国发展的模式可以予以借鉴。最后一部分笔者针对我国具体情况提出了完善这一机制的具体对策,即要分别对三种解决方式行政调解、行政裁决和行政纠纷作出不同的调整,以适合多种环境民事纠纷状况,在不同的案件中发挥不同的作用,都在最大程度上实现对这一纠纷的快速高效解决,应对纷繁复杂的实际状况,为我国环境民事纠纷的解决发挥出各自的作用。
[Abstract]:Since the Industrial Revolution, the world economy has undergone earth-shaking changes, but with the rapid development of the economy, environmental problems have also begun to emerge in large numbers. Human survival and development can never be separated from the constraints of the environment, it relates to the development of every country and every nation. The development of economy is accompanied by the exploitation and utilization of environment and resources. Among these disputes, environmental civil disputes are the largest in number. They not only cause great damage and threat to people's lives and property, but also cause huge pollution to the environment. Therefore, how to solve environmental civil disputes has become a major problem that all countries and regions have to face. Various countries and regions all over the world are constantly groping for the mechanism of resolving this dispute. In this process, a lot of theoretical research and practical exploration have been made. The administrative mechanism of environmental civil disputes is found to be a preferable solution mechanism in the continuous practice. Broadly speaking, the dispute resolution mechanism can be divided into two types, one is litigation mode, the other is non-litigation mode. For environmental disputes, the cost of litigation is high, and not professional; non-litigation is mainly administrative settlement of this way. This paper mainly introduces the administrative mechanism of environmental civil dispute, and the author mainly discusses it from four aspects. In this part, the basic concepts such as environmental civil disputes and administrative handling of environmental civil disputes are discussed. These basic concepts become the theoretical basis of the full text. Secondly, the general situation of administrative treatment of environmental civil disputes in China is given. The author emphatically analyzes several existing solutions such as administrative mediation, administrative adjudication and administrative arbitration. However, what should be paid attention to is the practice in our country. These three kinds of administrative treatment methods have not obtained the due effect, which question is many aspects, the author has made the detailed elaboration in this part. In the third part, the author introduces the experiences and lessons, dynamic mechanism and static legislation of foreign countries and regions, including Taiwan area of our country, from which we can draw lessons from the model that is suitable for the development of our country. In the last part, the author puts forward the concrete countermeasures to perfect this mechanism, that is, to adjust the three kinds of solutions, administrative mediation, administrative adjudication and administrative dispute respectively, in order to suit various environmental civil disputes. To play different roles in different cases, to the greatest extent to achieve the rapid and efficient resolution of this dispute, to deal with the complex situation of the actual situation, and to play a role in the settlement of civil environmental disputes in China.
