我国环境权救济机制研究

【摘要】：随着我国经济的飞速发展和工业化程度的提高，环境污染问题日益凸显，环境纠纷的数量和规模也在不断增加，环境问题正逐步成为现代社会人们所面临的一个严峻问题。环境权这一概念，也正是随着人们对环境问题的日渐关注而产生的，它强调了人们拥有在良好环境中生存和发展的权利。没有救济就没有权利，当人类在利用、改造自然的过程中因破坏环境而对人类自身权益造成的损害时，我们就应当拿起法律的武器，建立相应的制度，对环境权进行救济。与一般的侵权行为相比，环境侵权行为具有其自身的特征这使得传统的民事救济和行政救济方式无法满足环境侵权中对受害者权益的保护，暴露出我国环境权救济制度中所存在的种种缺失，也正是由于这些不足和缺陷，使得受害人在寻求救济的道路上困难重重，无法及时有效的获得救济。本文通过深入分析环境权和环境侵权的内涵及其特征，研究我国目前环境权救济的状况，指出我国现有的环境权救济制度中存在的不足，，并且通过对国外已经日臻成熟的环境权救济制度的研究，总结出可供我国吸取借鉴的、适合我国现实发展状况的切实可行的措施，来完善我国的环境权救济制度。笔者认为，我国环境权救济制度除了从公益诉讼、行政诉讼、民事诉讼等方面完善司法救济；还应该从环境纠纷解决机制等方面完善行政救济，特别是应当构建以强制性环境责任保险为主，以环境权社会保障制度、环境权公共补偿制度、等为辅的环境权社会救济制度，从而在整体上构建我国环境权救济体系，同时要充分重视民间环保组织在环境权救济方面的能力，调动一切可以调动的力量，共同实现对公民环境权就保护和救济。
[Abstract]:With the rapid development of China's economy and the improvement of the degree of industrialization, environmental pollution has become increasingly prominent, and the number and scale of environmental disputes are increasing. Environmental problems are becoming a serious problem in modern society. The concept of environmental rights is also emerging as people pay more attention to environmental problems. It emphasizes that people have the right to survive and develop in a good environment. Without relief, there is no right. When human beings are using and remaking nature to damage the human rights and interests caused by the destruction of the environment, we should take up the weapon of the law, establish the corresponding system, and Remedies the right to the environment.
Compared with the general tort, environmental tort has its own characteristics, which makes the traditional civil relief and administrative remedy can not meet the protection of the rights and interests of the victims in the environmental tort, exposes the various deficiencies in the system of environmental rights relief in our country, and it is also because of these deficiencies and defects that the victims are in the environment. There are many difficulties in seeking relief, and no relief can be obtained in time.
Through in-depth analysis of the connotation and characteristics of environmental right and environmental tort, this paper studies the current situation of environmental right relief in our country, points out the shortcomings of the existing environmental right relief system in our country, and summarizes the reference for our country through the study of the environmental right relief system which has matured in foreign countries, and is suitable for our country. In order to improve our country's environmental rights relief system, the author believes that our country's environmental rights relief system should improve the judicial relief in addition to public interest litigation, administrative litigation, civil litigation and so on, and should complete the administrative relief from the environmental dispute settlement mechanism and so on, especially the compulsory ring should be constructed. The situation liability insurance is mainly based on the social security system of environmental rights, the public compensation system of environmental rights, and the social relief system of environmental right, which is supplemented by the environmental right, so as to build our country's environmental right relief system as a whole. At the same time, we should pay full attention to the ability of the civil environmental protection organizations in the environmental rights relief, mobilize all the forces that can be mobilized and jointly realize the public. The rights of the people's environment are protected and remedied.
