生态文明视野下的循环经济立法研究

【摘要】:胡锦涛总书记在党的十七大报告中提出了建设生态文明和发展循环经济的战略任务:“建设生态文明,基本形成节约能源资源和保护生态环境的产业结构、增长方式、消费模式。循环经济形成较大规模,可再生能源比重显著上升。主要污染物排放得到有效控制,生态环境质量明显改善。生态文明观念在全社会牢固树立。”以生态文明理念为指导,发展循环经济,完善循环经济立法,是我国经济社会发展的必然要求。 2008年,我国通过了《循环经济促进法》,这标志着我国调整循环经济领域社会关系的基本法已经诞生。以《循环经济促进法》为首的循环经济法律,自实施以来,为促进我国循环经济发展提供了有力的法律保障。随着生态文明建设不断深入,社会经济形势日益发展,循环经济法律仍然存在或逐渐暴露出一些问题和不足,影响到其实施效果。社会发展对循环经济立法提出了新的更高要求。 社会发展趋势表明,当今世界正处于巨大变革和转型时期,主要表现为“三重转变”,即:人类文明形式由工业文明向生态文明转变,世界经济形态由资本经济和物质经济向知识经济和循环经济转变,社会发展道路由非持续发展向可持续发展转变。上述“三重转变”中,“生态文明”是核心范畴,“循环经济”是基本形式,“可持续发展”是根本目标。 在此背景下,本文试图通过跟踪和把握社会发展的最新趋势,把生态文明理念与循环经济立法结合起来进行专门研究,提取国外循环经济立法的基本经验,考察我国循环经济立法的现状,并检讨我国循环经济立法在理论、结构、制度和责任机制等方面存在的不足,从理论上提出促进我国循环经济立法理念进步、结构完备、制度完善和责任重塑的若干建议,以期推动立法不断发展,使之更加符合生态文明建设的要求,更好地促进和保障社会永续发展。这是本文的研究目的。 研究生态文明视野下的循环经济立法,不仅具有重要的理论价值,而且具有明显的实践意义。就理论价值而言,体现在三个方面:一是生态文明视野下的循环经济立法研究,注重自然科学、人文科学与社会科学的有机融合,充分吸收技术、经济和制度等各方面的理论成果,从而拓展生态文明研究的理论宽度,延伸生态文明的研究视野,优化生态文明理论的研究方法;二是把生态文明、循环经济与依法治国三者有机结合起来,既架设了与科学发展观联系的桥梁,又深化了科学发展观的科学内涵,使科学发展观获得了一种全新的解释路径,即从文明、经济和法治相互融合贯通的角度认识和理解科学发展观的科学内涵;三是借助生态文明这样一种强大的理论工具和厚重的价值理念来研究循环经济立法,提升了循环经济立法研究的思想高度,夯实了循环经济立法研究的理论基础。 就实践意义而言,包括三个方面:一是对循环经济立法的意义,有助于完善循环经济立法,为循环经济发展提供更有力的法制保障;二是对经济社会的意义,有利于推动循环经济发展,为建设资源节约型环境友好型社会贡献力量;三是对环境立法的意义,有助于促进我国环境立法的转型和完善,实现环境保护与经济发展的一体化。 除引言和结语外,全文一共分为六章。 第一章为本体论,主要论述生态文明、循环经济和循环经济立法三个核心范畴及其相互关系。生态文明是人类社会继原始文明、农业文明和工业文明之后的一种新型文明形态。环境问题及由此引发的生态危机是生态文明兴起的现实基础;人们在反思生态危机过程中对人与自然关系的反省与变革是生态文明兴起的思想渊源;生态保护运动的发展是生态文明兴起的重要推动力量。生态文明具有整体性、平等性和多样性。作为一种高级文明形态,生态文明大大丰富了人类文明的内涵,有力地推动了人类自然观的变革、生态伦理观的形成和人类发展观的转向,对保护生态环境、发展循环经济、实现人类社会永续发展具有重要意义。 循环经济是在生产、流通和消费等过程中进行的减量化、再利用、资源化活动的总称。循环经济具有系统性、循环性和环境友好性。在我国,循环经济作为一种新的经济发展模式,是以我国传统的高开采、高消耗、高排放、低利用、低产出的经济增长模式带来的资源约束和环境压力为背景提出来的。循环经济是建设资源节约型、环境友好型社会的重要途径,是落实科学发展观的重要体现,是缓解资源危机的必然选择,是保护生态环境的有效手段,是促进经济又好又快发展的有力方式,是实现经济社会可持续发展的重要保证。 就关系而言,生态文明是发展循环经济的指导思想和价值追求,发展循环经济是落实科学发展观建设生态文明的基本途径和具体实践。从本质上看,生态文明与循环经济是一致的,生态文明和循环经济都内含可持续发展因素,实现人与自然可持续发展是建设生态文明和发展循环经济的共同追求。 循环经济法不只包括形式意义上的《循环经济促进法》,还包括实质意义上的体现循环经济的减量化、再利用和资源化各项要求的所有立法。在内容上,它涉及与资源开发利用、能源节约、废物回收利用、生态产业等领域的相关立法;在形式上,它包括国家层面和地方层面的循环经济立法。在我国,循环经济立法可以划分为三个时期:2002年之前的萌芽阶段、2002年到2007年的成长阶段和2008年以后的定型阶段。2008年《循环经济促进法》的出台,标志着我国调整循环经济领域社会关系的基本法龙头法已经诞生。 第二章为借鉴论,主要介绍国外循环经济发展的法制建设,特别是发展循环经济领先的一些发达国家和地区的立法经验及其对我国的启示。在国外,德国、日本、欧盟等主要国家和地区均积极开展了循环经济立法。在考察发展循环经济领先的一些发达国家和地区循环经济立法的背景和现状,分析其立法内容和法律制度的基础上,总结出各国一些有益的做法和实践:循环经济法的理念不断进化,法的目标不断进步,法的体系逐渐完备,结构日趋合理,制度日益健全,内容日臻完善。其中一些具体经验和做法值得我国循环经济法制建设作为参考和借鉴。 第三章为原理论,主要论证我国循环经济法的理念、价值、定位和原则。本章认为,循环经济法的理念应当坚持生态化取向,实现法理念的生态化,即在立法中将法律的价值取向由人与人的社会秩序向人与自然的生态秩序扩展,引导、促进、规范和保障人与人、人与自然关系的和谐发展。这要求循环经济法由传统法的“人类中心主义”转向“生态中心主义”,以“生态利益优先”为价值理念。作为该理念的具体要求,循环经济法优先追求社会义务的承担。同时,就调整手段而言,循环经济法是“管制型立法”与“促进型立法”的有机融合。从利益角度分析,循环经济法是环境利益本位法,在部门法的定位上属于环境法而不是经济法。根据基本原则的价值性、特征性和普遍性要求,循环经济法的基本原则应当由两个构成:一是减量化、再利用和资源化原则,二是共同责任原则。这两个基本原则最能体现生态文明理念和循环经济法的理念和价值追求。 第四章为结构论,主要分析我国循环经济法律体系及其内部结构存在的不足并提出了完善建议。本章认为,循环经济法律体系是与循环经济相关的法律规范依一定的原则与规律组合而成的一个紧密联系的有机整体。它既包括专门的循环经济法律、法规、规章和标准,也包括宪法和其他体现循环经济内容的法律、法规和规章等不同效力等级法律规范当中的具体条文。我国建构循环经济法律体系的理念与生态文明理念还存在距离;宪法中缺乏循环经济条款的根本指导;能源、生态农业、资源综合利用和消费等专门领域的配套立法缺乏;相关标准规范空白;地方立法明显不足;环境保护、资源、能源、生产、流通、消费、废物综合利用等领域的法律与《循环经济促进法》之间的相互重合和不协调问题比较突出,某些方面的规定甚至相互矛盾和冲突。 完善循环经济法律体系,必须坚持以科学发展观和生态文明理念为指导思想,坚持生态法学方法论,破除行政管理型和部门立法型法律体系,构建科学的循环经济法律体系,突出“促进”型和参与式的法律体系,建立以法律、经济和技术手段为主,必要的行政手段为辅的循环经济法律制度体系;在宪法中增加发展循环经济的条款;建立和完善相关配套法规;制定相关标准规范;加强地方立法;加快其他法律的“生态化”;协调好能源、资源开发利用、污染防治等相关领域立法与《循环经济促进法》的关系问题,适时修订相关立法,使各项立法相互协调配套,发挥整体合力。 第五章为制度论,主要评估现行循环经济法律制度并对重点制度的完善提出具体建议。本章认为,发展循环经济、建设生态文明,必须要有科学合理有效的法律制度保障。构建和完善有利于推动循环经济健康发展并适应循环经济体系正常运行的法律制度,是循环经济法治建设的重要任务。根据在循环经济法中的地位、作用和适用范围的不同,循环经济的法律制度可以分为基本法律制度(基本制度)和专项法律制度(专项制度)。 循环经济发展规划制度,总量调控制度,循环经济评价指标体系和考核制度,以生产者为主的责任延伸制度,重点企业监督管理制度,循环经济统计、标准体系和产品资源消耗标识制度等构成了循环经济法的基本制度;而鼓励、限制和淘汰的技术、工艺、设备、材料和产品的名录制度,生态设计制度,拆解再利用制度等,属于循环经济法的专项制度。分析评估现行循环经济法律基本制度和专项制度的立法现状,发现各项制度还存在一些问题和不足。应当在生态文明理念的指导下,从制度的具体内容、法律效力和配套制度建设等方面对基本制度和专项制度进行完善。 第六章为责任论,主要检讨我国循环经济法律责任现状并提出以生态文明理念重塑循环经济法律责任体系。本章认为,从建设生态文明的要求而言,循环经济法律责任的概念应作广义理解,它既包括结果意义上的否定性法律后果,也包括行为意义上的积极性法律要求。强调政府、企业、其他组织和公民对循环经济发展的法律责任以及违反法定义务应承担相应的法律后果,必将更好地促使各个主体履行其发展循环经济的职责或义务,从而更好地推动循环经济的发展。《循环经济促进法》和相关法律法规以及规章从不同角度和层面规定了各个主体在循环经济发展中的法律责任。但是,在现有的循环经济法律责任规定中,还存在一些不足,如有的强制性行为缺乏责任机制,部分违法责任规定偏轻,对地方政府的责任约束不足,责任激励机制难以落实,责任内容不全面,责任社会化程度不足,责任保障机制不完善等。 为此,建议以生态文明理念为指导,从各个方面重塑循环经济法律责任:完善强制性行为的责任约束机制,强化违法行为处罚力度,强化地方政府的法律责任,强化责任激励机制,充实责任内容,积极发展保险、基金、社会保障等责任社会化机制,完善企业内部的责任保障机制和人大、司法、执法和公众参与保障机制。 为实现上述研究内容和目标,本文在研究方法上,主要运用了比较分析方法、历史分析方法、利益分析方法、系统分析方法等。比较分析方法贯穿于全文始终。文章对中外不同典型国家的循环经济立法进行了比较分析,对工业文明与生态文明进行了类比分析,对循环经济法与经济法进行了对比分析,等等。在分析循环经济立法的定位时,运用了利益分析的方法,阐述了循环经济法是环境利益本位法而不是经济利益本位法。这有别于传统的“调整对象”和“调整手段”的分析标准。历史分析法和系统分析法也在论文中得到充分体现。 必须承认的是,由于循环经济立法的发展时间不长,特别是《循环经济促进法》实施不久,有关循环经济法的理念、原则、体系、制度和责任的内容还需要在实践中不断检验和发展。随着生态文明建设的不断深入,社会经济形势不断发展,我国循环经济法还需要不断完善体系结构、具体制度和法律责任等规定,以更好地保障和推动生态文明建设的进一步发展。 总之,生态文明是指导我国循环经济立法的基本价值理念,是判断循环经济立法优劣的重要标准。循环经济法是推进我国生态文明建设的法制保障。循环经济法代表了环境法发展的新趋势。
[Abstract]:In the report of the 17th National Congress of the Party, General Secretary Hu Jintao put forward the strategic task of building ecological civilization and developing circular economy: "To build ecological civilization, basically form the industrial structure of saving energy and resources and protecting the ecological environment, the mode of growth, and the mode of consumption. The concept of ecological civilization has been firmly established in the whole society. "Guided by the concept of ecological civilization, developing circular economy and perfecting the legislation of circular economy are the inevitable requirements of China's economic and social development.
In 2008, China passed the Law on the Promotion of Circular Economy, which marks the birth of the basic law on the adjustment of social relations in the field of circular economy. With the development of social economy, some problems and shortcomings still exist or gradually expose in the law of circular economy, which affect the effect of its implementation.
The trend of social development shows that the world is undergoing tremendous transformation and transformation, which is mainly manifested in the "triple transformation": the transformation of human civilization from industrial civilization to ecological civilization, the transformation of world economic form from capital economy and material economy to knowledge economy and circular economy, and the transformation of social development from non-sustainable development to sustainable development. In the above three transformations, ecological civilization is the core category, circular economy is the basic form, and sustainable development is the fundamental goal.
In this context, this paper attempts to trace and grasp the latest trend of social development, the concept of ecological civilization and circular economy legislation to conduct a special study, extract the basic experience of foreign circular economy legislation, inspect the status of China's circular economy legislation, and review China's circular economy legislation in theory, structure, system and responsibility. In order to promote the continuous development of legislation, make it more in line with the requirements of the construction of ecological civilization, and better promote and guarantee the sustainable development of society, this paper puts forward some suggestions to promote the progress of the concept of circular economy legislation, perfect the structure, perfect the system and remould the responsibility.
To study the legislation of circular economy under the vision of ecological civilization is not only of great theoretical value, but also of obvious practical significance. As far as its theoretical value is concerned, it is embodied in three aspects: firstly, the study of circular economy legislation under the vision of ecological civilization, paying attention to the organic integration of natural science, humanities and social sciences, and fully absorbing technology. The theoretical achievements of economy and system, thus expanding the theoretical breadth of the study of ecological civilization, extending the research vision of ecological civilization, and optimizing the research methods of ecological civilization theory; the second is the organic combination of ecological civilization, circular economy and the rule of law, which not only establishes a bridge linking with the scientific concept of development, but also deepens. The scientific connotation of the scientific outlook on development has given it a brand-new interpretation path, that is, to understand and understand the scientific connotation of the scientific outlook on development from the perspective of the integration of civilization, economy and the rule of law; and to study the legislation of circular economy with the help of such a powerful theoretical tool as ecological civilization and a strong concept of value. It has raised the ideological height of circular economy legislation research and laid a solid foundation for the study of circular economy legislation.
As far as the practical significance is concerned, it includes three aspects: first, the significance of circular economy legislation is helpful to perfect circular economy legislation and provide more powerful legal guarantee for the development of circular economy; second, the significance of economic and social development is conducive to promoting the development of circular economy and contributing to the construction of a resource-saving and environment-friendly society; third, the significance of circular economy legislation is conducive to the development of circular economy. The significance of environmental legislation is conducive to promoting the transformation and perfection of environmental legislation in China and realizing the integration of environmental protection and economic development.
In addition to the introduction and conclusion, the full text is divided into six chapters.
The first chapter is the ontology, mainly discussing the three core categories of ecological civilization, circular economy and circular economy legislation and their relationship. People reflect on the relationship between man and nature in the process of ecological crisis is the ideological origin of the rise of ecological civilization; the development of ecological protection movement is an important driving force for the rise of ecological civilization. The connotation of human civilization has powerfully promoted the change of human nature outlook, the formation of ecological ethics and the change of human development outlook. It is of great significance to protect the ecological environment, develop circular economy and realize the sustainable development of human society.
Circular economy is a general term for reducing, reusing and resource-based activities in the process of production, circulation and consumption. Circular economy is systematic, cyclical and environmentally friendly. In China, as a new economic development model, circular economy is a traditional economy with high exploitation, high consumption, high emission, low utilization and low output. Circular economy is an important way to build a resource-saving and environment-friendly society, an important embodiment of the scientific concept of development, an inevitable choice to alleviate the resource crisis, an effective means to protect the ecological environment, and an effective means to promote sound and rapid economic development. A powerful way is an important guarantee for achieving sustainable economic and social development.
As far as the relationship is concerned, ecological civilization is the guiding ideology and value pursuit of developing circular economy, and the development of circular economy is the basic way and concrete practice of implementing the scientific concept of development to build ecological civilization. Natural sustainable development is the common pursuit of building ecological civilization and developing circular economy.
The circular economy law includes not only the formal meaning of the Circular Economy Promotion Law, but also all the legislation that embodies the requirements of the circular economy reduction, reuse and recycling. In China, the legislation of circular economy can be divided into three stages: the budding stage before 2002, the growing stage from 2002 to 2007 and the finalized stage after 2008. The promulgation of the Circular Economy Promotion Law in 2008 marks the adjustment of the circular economy community in China. The leading law of the basic law has been born.
In the second chapter, the author mainly introduces the legal construction of the development of circular economy in foreign countries, especially the legislative experience of some developed countries and regions leading in the development of circular economy and Its Enlightenment to China. On the basis of analyzing the legislative content and legal system of circular economy in some developed countries and regions, this paper sums up some useful practices and practices in various countries: the concept of circular economy law is constantly evolving, the objectives of the law are constantly progressing, the legal system is gradually perfect, the structure is becoming more reasonable, the system is increasingly perfect, and the content is becoming more and more perfect. Some concrete experiences and practices are worthy of reference and reference for the legal construction of circular economy in China.
The third chapter is the theory of principle, mainly demonstrating the concept, value, orientation and principle of China's circular economy law. To standardize and guarantee the harmonious development of the relationship between man and man, man and nature, it is necessary for the circular economy law to change from the anthropocentrism of the traditional law to the ecocentrism and take the priority of ecological interests as its value concept. From the perspective of interests, the circular economy law is the environmental interest-based law, which belongs to the environmental law rather than the economic law. According to the value, characteristics and universality of the basic principles, the basic principles of the circular economy law should be based on. These two basic principles can best reflect the concept of ecological civilization and the concept and value pursuit of circular economy law.
The fourth chapter is the structure theory, mainly analyzes the shortcomings of the legal system of circular economy and its internal structure in China and puts forward some suggestions for improvement. Environmental economic laws, regulations, rules and standards also include the specific provisions of the Constitution and other laws, regulations and regulations that embody the contents of circular economy. Lack of supporting legislation in energy, ecological agriculture, comprehensive utilization and consumption of resources, blank of relevant standards and norms, insufficient local legislation, overlap and inconsistency between laws in the fields of environmental protection, resources, energy, production, circulation, consumption and comprehensive utilization of waste and the Circular Economy Promotion Law Prominent, some aspects of the provisions even contradict and conflict with each other.
To perfect the legal system of circular economy, we must adhere to the scientific concept of development and the concept of ecological civilization as the guiding ideology, adhere to the methodology of ecological law, abolish the administrative and departmental legislative legal system, construct a scientific legal system of circular economy, highlight the "promotion" and participatory legal system, and establish a legal, economic and technological system. The legal system of circular economy with the main means supplemented by the necessary administrative means; the provision for the development of circular economy added to the Constitution; the establishment and improvement of relevant supporting laws and regulations; the formulation of relevant standards and norms; the strengthening of local legislation; the acceleration of the "ecology" of other laws; the coordination of energy, resources development and utilization, pollution prevention and control, etc. The relationship between legislation in relevant fields and Circular Economy Promotion Law should be revised in time so as to coordinate and complement each other.
The fifth chapter is the system theory, which mainly evaluates the current legal system of circular economy and puts forward concrete suggestions for the improvement of the key system. Regular operation of the legal system is an important task of the construction of the rule of law in circular economy. According to the status, role and scope of application in the law of circular economy, the legal system of circular economy can be divided into basic legal system (basic system) and special legal system (special system).
