生态补偿中的发展机会补偿制度研究

【摘要】：生态环境是人类生存和发展的基础,如何在环境保护和经济发展中找到一个平衡点,成为了世界各国普遍关注的问题。而生态补偿机制为其提供了切实可行的理论基础和实践经验,同时,发展机会补偿制度作为生态补偿机制的有机组成部分之一,又是生态补偿机制建立和完善的必经之路,它能有效促成生态环境保护与经济社会发展的合理博弈格局,逐渐恢复生态保护区的生态功能和价值。 发展机会补偿制度是指通过经济、法律、行政等手段,对于生态保护者因为保护环境而丧失的发展机会,未来利益进行经济、物质和非经济补偿的一种制度。它实际上解决的是生态保护者与生态受益者之间的利益分配不均的问题,是对生态补偿机制的完善和健全。它与现实损害补偿制度相辅相成,共同构成了生态补偿机制。构建发展机会补偿制度是非常必要的,它在实质上是生态正义的体现,是对当今的生态补偿机制存在的缺陷的弥补,顺应了现实形势的需要与环境保护的客观需要。 发展机会补偿是生态补偿中一个全新的理念,要进行发展机会补偿,我们就要明确它所涉及的各个利益主体所处的地位,从而确定它们之间的权利,义务和责任,同时采用综合性的补偿方式、建立以受偿主体丧失的实际和发展机会利益来确定的补偿标准、采取合理的救济途径等也是发展机会补偿制度的应有之义。 由于理论和实践的不成熟,我国在构建发展机会补偿制度时出现了一系列的问题:如法律依据不足、补偿范围与标准不明确、补偿主体不确定以及市场机制不健全等。这需要我们在借鉴国外先进经验的基础上,加强立法、完善制度内容、健全市场机制,逐步建立和完善我国的发展机会补偿制度。
[Abstract]:Ecological environment is the basis of human survival and development. How to find a balance between environmental protection and economic development has become a universal concern in the world. The ecological compensation mechanism provides it with practical theoretical basis and practical experience. At the same time, the development of opportunity compensation system, as an organic part of the ecological compensation mechanism, is the only way to establish and perfect the ecological compensation mechanism. It can effectively promote the rational game pattern of ecological environment protection and economic and social development, and gradually restore the ecological function and value of ecological reserve. Development opportunity compensation system is an economic, material and non-economic compensation system through economic, legal, administrative and other means. In fact, it solves the problem of uneven distribution of benefits between ecological protectors and ecological beneficiaries, and it is the perfection and perfection of ecological compensation mechanism. It complements with the actual damage compensation system and constitutes the ecological compensation mechanism. It is very necessary to construct the system of compensation for development opportunities, which is in essence the embodiment of ecological justice, the remedy of the defects existing in the ecological compensation mechanism of today, and conforms to the needs of the actual situation and the objective needs of environmental protection. Development opportunity compensation is a completely new concept in ecological compensation. In order to make development opportunity compensation, we must make clear the position of the various stakeholders involved in it, so as to determine the rights, obligations and responsibilities between them. At the same time, adopting a comprehensive compensation method, establishing the compensation standard determined by the loss of the actual and development opportunity benefits of the subject, and adopting reasonable relief ways are also the proper meanings of the development opportunity compensation system. Due to the immaturity of theory and practice, a series of problems have appeared in the construction of compensation system of development opportunity in our country, such as insufficient legal basis, unclear compensation scope and standard, uncertain compensation subject and imperfect market mechanism, etc. This requires us to strengthen legislation, perfect the content of the system, perfect the market mechanism, and gradually establish and perfect the compensation system of our country's development opportunity on the basis of drawing lessons from the advanced experience of foreign countries.
