可持续发展理念下我国能源法律制度研究

【摘要】： 能源是经济和社会发展的命脉,能源的发展能够推动社会经济的发展。然而,长期以来,我国把经济建立在大量消耗能源基础上,给能源的发展带来了一些严重问题:人均能源占有量不足,能源结构不合理,清洁能源利用低,能源供需矛盾尖锐,能源利用与对环境发展不协调。能源领域的这些问题成为我国社会、经济与环境可持续发展的一个重要的限制因素。随着可持续发展理念在全球各领域的不断深入,能源的可持续发展也被提上日程。能源的可持续开发利用既能为经济的发展提供充足的能源资源,又能够有效保护环境,改变能源结构。为了解决能源问题以及在源保护我们赖以生存的环境,我国实施了能源可持续发展战略。能源的可持续发展需要一个良好的社会环境,因此为了推进我国能源可持续发展,规范能源的开发利用,我们就必须将其纳入到法制的轨道上。 本文的结构安排包括引言、主体部分和结语,主体部分包括四部分。第一部分是可持续发展理念与能源法律制度概述。从能源概念入手,介绍了能源的可持续发展,并分析了可持续发展理念对我国能源战略的影响及在可持续理念下完善能源法律制度的必要性。随后重点介绍了能源可持续发展的三个理论基础,即可持续发展理论、循环经济理论、公民环境权理论。这些理论为我国能源的可持续发展奠定坚实的理论基础。第二部分是国外能源法律制度比较。首先介绍了美国、欧盟、日本能源法律制度的概况。然后在分析了国外能源法律制度特点和国外能源可持续开发利用具体制度的基础上总结了国外能源法律制度对我国能源可持续开发利用的启示,以便知道我国能源的可持续利用。第三部分是我国能源法律制度现状分析。介绍了我国目前能源开发利用的情况,分析了我国能源法律制度的不足,需要完善我国能源法律制度。第四部分在借鉴国外先进经验和结合我国基本国情的基本上,以可持续发展理论为指导思想,提出完善我国能源法律制度设想。笔者主要从能源立法基本原则、完善能源法律体系、完善国家目标制度、建立现代能源监管制度、完善能源财税制度、定价机制和研发机制等方面提出了一些意见,希望为我国能源的可持续发展尽绵薄之力。
[Abstract]:Energy is the lifeblood of economic and social development. However, for a long time, China has built its economy on the basis of a large amount of energy consumption, which has brought some serious problems to the development of energy resources: the lack of energy per capita, the unreasonable energy structure, the low utilization of clean energy, and the sharp contradiction between supply and demand of energy. Energy use is not in harmony with the development of the environment. These problems in the field of energy have become an important limiting factor for the sustainable development of our society, economy and environment. With the continuous development of the concept of sustainable development in various fields of the world, the sustainable development of energy has also been put on the agenda. The sustainable development and utilization of energy can not only provide sufficient energy resources for economic development, but also effectively protect the environment and change the energy structure. In order to solve the energy problem and protect the environment that we depend on in the source, our country has implemented the strategy of energy sustainable development. The sustainable development of energy needs a good social environment, so in order to promote the sustainable development of energy in China and standardize the development and utilization of energy, we must bring it into the track of legal system. The structure of this paper includes the introduction, the main part and the conclusion, the main part includes four parts. The first part is an overview of the concept of sustainable development and the legal system of energy. Starting with the concept of energy, this paper introduces the sustainable development of energy, and analyzes the influence of the concept of sustainable development on China's energy strategy and the necessity of perfecting the legal system of energy under the concept of sustainable development. Then it introduces three theoretical bases of energy sustainable development, that is, sustainable development theory, circular economy theory and citizen environmental right theory. These theories lay a solid theoretical foundation for the sustainable development of energy in China. The second part is the comparison of foreign energy legal system. First of all, the introduction of the United States, the European Union, Japan's energy legal system overview. Then, on the basis of analyzing the characteristics of foreign energy legal system and the specific system of foreign energy sustainable development and utilization, the enlightenment of foreign energy legal system to the sustainable development and utilization of energy in China is summarized. In order to know the sustainable use of energy in China. The third part is the analysis of the current situation of China's energy legal system. This paper introduces the current situation of energy exploitation and utilization in our country, analyzes the deficiency of our country's energy legal system, and needs to perfect our country's energy legal system. In the fourth part, referring to the advanced experience of foreign countries and combining with the basic national conditions of our country, and taking the theory of sustainable development as the guiding ideology, the author puts forward the idea of perfecting our country's energy legal system. The author puts forward some suggestions from the aspects of basic principles of energy legislation, perfecting energy legal system, perfecting national target system, establishing modern energy supervision system, perfecting energy finance and taxation system, pricing mechanism and R & D mechanism, etc. Hope to contribute to the sustainable development of energy resources in China.
