环境法视野下我国小矿的法律规制

【摘要】： 小矿作为矿业部门的主要组成部分,其在世界各国的经济发展中都起到了不可代替的作用。20世纪60年代末,各国开始关注小矿问题,纷纷开始立法用法律手段规范小矿的健康有序发展,其立法上呈现出由少到多,从大、小矿一体立法到对小矿专章立法或单独立法的发展态势。小矿多,大矿少的地质赋存特点决定在相当长的时间内,小矿在我国的存在和发展是必然的。小矿数量之多,矿种之广的具体情况,研究小矿的法律制度是我国法治建设所需,也是矿区可持续发展的必然要求。小矿不仅仅是开采活动,它更牵动千千万万人的生计,担负着消除贫困的重任。矿难声声,令人扼腕!我们为这些鲜活生命的消逝而悲痛惋惜之余,我们更应该思考如何用法律的手段来规范小矿行为,让小矿在环保和安全方面承担起应有的社会责任。本文从对小矿的界定入手,指出小矿立法中存在的不足,借鉴国外的小矿法律制度和先进管理经验,提出完善我国小矿法律制度的建议。
[Abstract]:As a major component of the mining sector, small mines have played an irreplaceable role in the economic development of countries all over the world. At the end of the 1960s, all countries began to pay attention to the problem of small mines. One after another, legislation began to regulate the healthy and orderly development of small mines by legal means, and its legislation showed a trend of development from less to more, from big and small mining legislation to special legislation or separate legislation on small mines. The existence and development of small ore in our country is inevitable in a long time. Because of the large number of small mines and the wide variety of mines, it is necessary to study the legal system of small mines for the construction of the rule of law in our country, and is also an inevitable requirement for the sustainable development of mining areas. Small mines are not just mining activities, they also affect the livelihood of millions of people, shoulder the task of poverty eradication. The sound of the mine disaster makes people wriggle! In addition to lamenting the loss of these living lives, we should also consider how to regulate the behavior of small mines by means of law, so that small mines can assume their due social responsibility for environmental protection and safety. Starting with the definition of small mines, this paper points out the shortcomings in the legislation of small mines, draws lessons from the legal system and advanced management experience of foreign small mines, and puts forward some suggestions to perfect the legal system of small mines in China.
