公众参与环境影响评价制度法律问题研究

【摘要】: 改革开放以来,我国的国民经济取得了重大成就,但伴随的环境污染也不断加剧。面对环境的日益恶化,我国环保制度的不健全,特别是环境影响评价制度的流于形式难辞其咎。环境影响评价制度是为预防和减轻拟从事的开发行为对环境可能造成的不良影响而实施的一项环境法律制度。公众参与是环评机制能够发挥效用的关键环节,它可以使公众了解拟从事的开发行为以及由此可能引起的重大的、潜在的环境问题,增强开发行为的合理性和社会可接受性。 本文以完善公众参与环境影响评价制度为研究对象。首先,从理论角度出发,对公众参与环境影响评价制度的相关定义进行界定,系统阐述了其理论基础及实施的必要性,并介绍了国外和我国公众参与环境影响评价制度的发展进程。我国的公众参与环境影响评价制度起步较晚,与先进国家相比存在一定的差距,但也取得了一些成果。国家环保总局于2006年2月22日正式发布中国环保领域第一部公众参与的规范性文件——《环境影响评价公众参与暂行办法》,于同年3月18日起正式实施。该《暂行办法》将为推进和规范我国公众参与环境影响评价制度发挥巨大作用。其次,从实际出发,通过对公众参与环境影响评价现状的分析,概括出我国公众参与环境影响评价制度在实际运用中存在的诸多问题。主要包括:公众参与形式过于单一;未涉及环境信息的被动公开;不注重对公众意见的处理;公众参与环境影响评价的救济措施不力;公众参与环境影响评价的意识淡薄。最后,为了弥补我国公众参与环境影响评价制度上的不足,本文从建立完善环境信息公开制度、参与机制和环境公益诉讼制度三个方面入手:通过建立环境信息的被动公开方式,为公众参与环境影响评价创造良好的前提条件;通过对环境影响评价中公众参与的主体和方式两方面的论述以完善公众在环境影响评价中的参与机制;通过构建我国的环境公益诉讼制度,促使公众参与环境影响评价制度在法律的保障下健康发展,从而达到完善我国公众参与环境影响评价制度的目的。
[Abstract]:Since the reform and opening up, China's national economy has made great achievements, but the accompanying environmental pollution is also increasing. In the face of the worsening of the environment, the imperfection of the environmental protection system in our country, especially the imperfections of the environmental impact assessment system, can hardly be absolved. Environmental impact assessment (EIA) system is an environmental legal system to prevent and mitigate the possible adverse effects of the proposed development actions on the environment. Public participation is a key link in the effectiveness of the EIA mechanism. It can make the public understand the development behavior to be engaged in and the significant and potential environmental problems that may arise therefrom, and enhance the rationality and social acceptability of the development behavior. In this paper, the public participation in environmental impact assessment system as the research object. First of all, from the theoretical point of view, the definition of public participation in environmental impact assessment system is defined, and the theoretical basis and the necessity of its implementation are systematically expounded. It also introduces the development process of public participation in environmental impact assessment system in foreign countries and China. China's public participation in environmental impact assessment system started late, compared with the developed countries, there is a certain gap, but also achieved some results. On February 22, 2006, the State Environmental Protection Administration officially issued the first normative document on public participation in the field of environmental protection in China-"interim measures for Public participation in Environmental impact Assessment", which was formally implemented on March 18 of the same year. The interim measures will play an important role in promoting and standardizing public participation in environmental impact assessment in China. Secondly, by analyzing the current situation of public participation in environmental impact assessment, this paper summarizes the problems existing in the practical application of public participation in environmental impact assessment. Mainly include: the form of public participation is too single; not involved in the passive disclosure of environmental information; do not pay attention to the treatment of public opinion; the public participation in environmental impact assessment relief measures are weak; public participation in environmental impact assessment awareness is weak. Finally, in order to make up for the deficiency of the public participation in the environmental impact assessment system in China, this paper starts with the establishment and improvement of the environmental information disclosure system. Three aspects of participation mechanism and environmental public interest litigation system: through the establishment of the passive disclosure of environmental information to create a good prerequisite for public participation in environmental impact assessment; In order to perfect the mechanism of public participation in environmental impact assessment, to perfect the mechanism of public participation in environmental impact assessment, to construct the system of environmental public interest litigation in our country, through the discussion of the subject and mode of public participation in environmental impact assessment. To promote public participation in environmental impact assessment system under the protection of the law to develop healthily, so as to improve the public participation in environmental impact assessment system.
