绿色消费促进的若干法律问题研究

【摘要】：大量生产、大量消费、大量废弃的消费主义生活方式造成了人类和资源之间关系的紧张,加剧了生态破坏、环境恶化。因此,改变消费方式,从法律制度上规范消费行为,促进绿色消费,是实现可持续发展,解决环境问题,实现人与自然和谐的基本路径之一。 本文就如何通过法律规制促进绿色消费所需要涉及的若干法律问题进行探讨,主要包含以下四部分：第一部分综述绿色消费概况,界定绿色消费的概念、性质、理论来源,分析绿色消费主体、客体,权利、义务和法律责任等,阐述以法律保障绿色消费的必要性。第二部分介绍国外绿色消费状况,分析国外对绿色消费所做的法律规定及对我国绿色消费促进的启示。第三部分总结了我国绿色消费促进法律规范的渊源,通过对我国绿色消费的现状进行分析,指出我国绿色消费存在的问题；第四部分对我国绿色消费促进法律规范的制定进行了思考,尝试完善我国绿色消费促进相关法律规范和制度。
[Abstract]:Mass production, mass consumption, and a large number of abandoned consumerist lifestyles have caused tension between human beings and resources, aggravated ecological destruction and environmental degradation. Therefore, changing consumption mode, standardizing consumption behavior from legal system and promoting green consumption is one of the basic ways to realize sustainable development, solve environmental problems and realize harmony between man and nature. This paper probes into some legal problems that need to be involved in promoting green consumption through legal regulation. It mainly includes the following four parts: the first part summarizes the general situation of green consumption, defines the concept, nature and theoretical source of green consumption. This paper analyzes the subject, object, right, obligation and legal responsibility of green consumption, and expounds the necessity of protecting green consumption by law. The second part introduces the situation of green consumption in foreign countries, analyzes the legal regulations made by foreign countries on green consumption and the inspiration to the promotion of green consumption in China. The third part summarizes the legal origin of green consumption in China and points out the existing problems of green consumption through the analysis of the current situation of green consumption in China. In the fourth part, the author thinks about the establishment of green consumption promotion laws and regulations in China, and tries to perfect the relevant legal norms and systems of green consumption promotion in China.
