中国企业赴蒙古投资矿业法律风险分析

【摘要】：研究目的:进入21世纪以来,世界矿产资源和矿产品需求持续强劲,蒙古国拥有巨大的矿产资源储量,在全球矿业投资热潮中日益成为全球资本的热土,中国企业赴蒙投资日渐状大和深入。为此,本文将重点介绍蒙古国矿业资源及开发现状、与矿业投资相关的法规、中国企业在蒙古投资的现状、金融危机后蒙古矿业投资的新动向,分析中国企业在蒙古国矿业投资的现状和优势,探讨中国企业在蒙古国投资可能存在的风险,以便为中国企业在蒙古国投资提供参考。研究结论:经过分析,作者认为中国企业应当借机加大在蒙古国投资矿业,并为此提出了具体的化解投资风险的措施,包括认真学习蒙古法律、做好项目可行性研究、详细核查矿权及相关证明文件、加强与各级政府之间的沟通等。相信通过这些措施的实施,中国企业在蒙古投资矿业将会进入一个健康、快速发展的时期。
[Abstract]:Research purpose: since entering the 21st century, the demand for mineral resources and mineral products in the world has continued to be strong. Mongolia has huge reserves of mineral resources and has become a hot land of global capital in the global mining investment boom. Chinese enterprises to invest in Mongolia increasingly large and in-depth. Therefore, this paper will focus on the present situation of Mongolia's mining resources and development, the laws and regulations related to mining investment, the present situation of Chinese enterprises' investment in Mongolia, and the new trend of Mongolian mining investment after the financial crisis. This paper analyzes the present situation and advantages of Chinese enterprises' investment in Mongolian mining industry, and probes into the possible risks of Chinese enterprises' investment in Mongolia in order to provide reference for Chinese enterprises to invest in Mongolia. Conclusion: after analysis, the author thinks that Chinese enterprises should take advantage of the opportunity to increase investment in the mining industry in Mongolia, and put forward specific measures to solve the investment risk, including studying the Mongolian law seriously and doing a good project feasibility study. Check mining rights and related documents in detail, strengthen communication with governments at all levels. It is believed that through the implementation of these measures, Chinese enterprises will enter a healthy and rapid development period when they invest in the mining industry in Mongolia.
