中国环境管理大部制变革的回顾与反思

【摘要】:环境管理大部制变革是中国环境治理的中心环节。环境主管部门法律地位渐次提升,能够保障对经济和社会发展事务进行环境状况审查,缓解经济发展和环境保护之间紧张局面。但环境主管机关法定职能的有效发挥,需依赖其它涉及环境部门体制改革的协力推行,以及中央与地方环境权力的合理配置。环境督察体制与土地督察体制相比,在权力来源、管理体制及职能权限方面存在诸多差异,比照土地督察体制,创新环境督察体制,使其法定授权职能有效发挥,或可作为解脱环境管理体制困境的纾缓之策。
[Abstract]:Environmental management system reform is the central link of environmental governance in China. The legal status of the environmental authorities has been gradually upgraded, which can ensure the examination of the environmental status of economic and social development affairs and ease the tension between economic development and environmental protection. However, the effective exertion of the statutory functions of the environmental authorities depends on the cooperative implementation of the system reform of other environmental departments and the rational allocation of the central and local environmental powers. Compared with the land supervision system, there are many differences in power sources, management systems and functions and limits of authority between the environmental supervision system and the land supervision system. It can be used to relieve the predicament of the environmental management system.
