我国城市棕色地块治理的法律问题研究

【摘要】:在我国城市化进程不断加快,中心城区土地资源已十分短缺的背景下,棕色地块开发已成为城市土地可持续利用的重要手段,而在这个过程中棕色地块的治理问题已经成为制约土地开发的重要因素。所以如何有效地对棕色地块进行治理,已经成为城市土地可持续利用中一个不可忽视的问题。 文章首先对论文的研究对象——城市棕色地块进行界定,指出论文所研究的问题属于治理历史遗留的土壤污染问题的范畴。然后具体考察了美国在治理棕色地块方面做出巨大贡献的超级基金法案、欧盟先进的棕色地块治理开发经验、日本严密的棕色地块治理开发体系。 最后,从四个方面提出我国治理棕色地块的法律对策。第一:构建政府与开发商订立环境行政合同的治理模式。从强化政府土壤污染治理责任的必要性说起,对政府与开发商在棕色地块治理中的角色进行定位,并对该治理模式的可行性进行分析。其次解决的是棕色地块的治理资金来源,政府作为公众利益的代表,应该承担起建立稳定、可靠的资金筹措机制,确保资金有足够的额度以支持土壤污染治理和修复的高额费用。再次,在立法和制度层面完善城市棕色地块的治理。应填补中国立法在棕色地块治理这一领域的空白,针对城市地区中不同土地类型对土壤中污染物质的要求含量不同、按照不同用途来制定土壤质量标准。引入风险预警原则,对于城市棕色地块,要先评价,后使用。最后,完善综色地块规划及信息登记等配套制度,提出了土地利用规划由人大来组织制定的新思路,为了实现保障土地权利或为土地权利者更好地行使土地权利,应该建立动态申报制度,建立一整套完善的污染场地的信息登记制度。
[Abstract]:Under the background of rapid urbanization and shortage of land resources in central urban areas, the development of brown plots has become an important means of sustainable use of urban land. In this process, the governance of brown land has become an important factor restricting land development. Therefore, how to effectively control brown land has become a problem that can not be ignored in the sustainable use of urban land. This paper first defines the research object of this paper, that is, the urban brown plot, and points out that the problems studied in this paper belong to the category of controlling soil pollution left over from history. Then the superfund bill which made a great contribution to the management of brown plots in the United States, the advanced experience of the European Union in the management and development of brown plots, and the strict system of governance and development of brown plots in Japan are examined in detail. Finally, from four aspects, the author puts forward the legal countermeasures for the administration of brown plots in our country. The first: construct the governance model that the government and the developer conclude the environmental administration contract. Starting from the necessity of strengthening the responsibility of the government for soil pollution control, the role of the government and the developers in the treatment of brown plots is fixed, and the feasibility of the model is analyzed. Secondly, the government, as the representative of the public interest, should assume the responsibility of establishing a stable and reliable financing mechanism for the governance of brown plots. Ensure that funds are adequate to support the high cost of soil pollution control and remediation. Third, improve the governance of urban brown land at the legislative and institutional level. It is necessary to fill in the blank of Chinese legislation in the field of brown land treatment and to formulate soil quality standards according to the different uses of different land types in urban areas. Introduction of risk warning principle, for urban brown land, first evaluation, then use. Finally, we improve the supporting systems such as comprehensive land plot planning and information registration, and put forward a new idea of land use planning organized by the National people's Congress, in order to realize the protection of land rights or the better exercise of land rights for land rights holders. A dynamic declaration system should be established and a complete set of information registration systems for contaminated sites should be established.
