北京市园林绿化立法问题研究

【摘要】：该文通过对历史资料的分析,综合运用历史考察、归纳总结等方法对北京市园林绿化立法的历史与现状进行了梳理和分析,初步了解了三十年来北京市园林绿化立法的发展阶段并根据北京市园林绿化立法文本进行分析,阐述了其立法特征,论述了北京市在具体园林绿化立法实践过程中通过了哪些法律手段来促进北京市园林绿化事业的发展及成就与不足。同时,通过这一地方性立法的微观个案研究,提出了地方在进行园林绿化立法过程中应当遵循中央立法原则,要结合当地具体情况,大胆实践,勇于创新。本文提出了切实可行的完善思路,特别是从立法体系、立法理念、立法内容、园林绿化管理体制等方面提出了较为具体完善的对策。特别是为了提高地方园林绿化立法质量,确保地方园林绿化立法作用能够得到更好的发挥与落实,本文尝试着提出了一套可行的园林绿化立法评估体系,以期对我国今后的地方园林绿化立法实践能够有所帮助与借鉴。
[Abstract]:This paper analyzes the history and present situation of Beijing's landscaping legislation through the analysis of historical data, comprehensive application of historical investigation, induction and summary, etc. The development stage of Beijing landscaping legislation in the past 30 years has been preliminarily understood and analyzed according to the text of Beijing landscaping legislation, and its legislative characteristics have been expounded. In this paper, the author discusses what legal means Beijing has adopted to promote the development, achievements and shortcomings of Beijing's landscaping in the course of its legislation practice. At the same time, through the microcosmic case study of this local legislation, the author puts forward that the local government should follow the central legislative principle in the process of the legislation of landscape and greening, and should combine with the local specific conditions, practice boldly and innovate bravely. This paper puts forward practical and feasible ideas for perfection, especially from the aspects of legislative system, legislative idea, legislative content, management system of landscaping and so on, and puts forward more concrete and perfect countermeasures. Especially in order to improve the quality of local landscape legislation and ensure that the legislative role of local landscaping can be better played and implemented, this paper tries to put forward a set of feasible legislative evaluation system of landscape greening. In order to our country in the future local landscaping legislation practice can be helpful and reference.
