论矿业权的民法规制

【摘要】：矿业权是在矿产资源所有权基础上产生的权利,矿业权依据矿产资源所有权派生而来,具有鲜明的物权特性,属于一种特殊的用益物权。矿业权是一种关乎国计民生的民事权利,但理论界对其投入的关注程度却与其重要性不成正比。对矿业权人保护不力的现象在现实中十分普遍,迫切需要在法律上明确其物权性质。矿业权法律关系包括主体、客体和内容,而作为矿业权的客体矿产资源具有消耗性、不可再生性、分布不均匀性和隐蔽性等特点,由此形成了矿业权与一般物权的巨大差别。矿业权的取得分为原始取得和继承取得。矿业权流转分为一级市场二级市场,一级市场指的是初始交易,多为垄断市场；二级市场是矿业权的再交易,由矿业权的受让人再行转让,并且还要进行不动产登记。矿业权之间、矿业权与土地权利之间都存在着一定的权利冲突,在立法上要对这些冲突加以解决。矿业权的行使有一定的限度不能危害国家利益、环境等公共利益以及第三人利益。本文通过对外国矿业权立法例、矿业权学说理论以及我国矿产资源法的研究,提出了我国有关矿业权法律制度在矿业权的民事流转以及解决矿业权与有关权利、国家利益、公共利益以及第三人利益的冲突上还须完善的思路。
[Abstract]:Mining right, which is derived from the ownership of mineral resources, is a kind of special usufruct right. Mining right is a kind of civil right related to the national economy and people's livelihood, but the attention paid by the theorists to it is not proportional to its importance. The phenomenon of weak protection of mining owners is very common in reality, and it is urgent to clarify the nature of real right in law. The legal relationship of mining rights includes subject, object and content. As the object of mining rights, mineral resources have the characteristics of consumptive, non-reproducible, uneven distribution and concealment, thus forming the great difference between mining rights and general real rights. The acquisition of mining right is divided into original acquisition and inheritance acquisition. The circulation of mining rights is divided into the secondary market of the primary market, which refers to the initial transaction, most of which is the monopoly market; the secondary market is the retransaction of the mining right, which is transferred again by the transferee of the mining right and the registration of real estate. There are some conflicts between mining rights, mining rights and land rights, which should be resolved in legislation. The exercise of mining rights cannot harm the public interests, such as the national interests, the environment and the interests of the third party. Based on the research of foreign mining right legislation, mining right theory and mineral resources law, this paper puts forward the civil circulation of mining right legal system in our country and the solution of mining right and related rights, national interests. The conflict of public interest and third party's interest should be perfected.
