我国军事环境法立法研究

【摘要】：保护环境,实现可持续发展,已成为世界各国人民的共识和强烈愿望。军事环境保护作为国家环境保护的重要组成部分,军事活动所产生的环境问题直接影响着国家环境保护工作的整体效益。因此,加强军事环境保护方面的立法,完善军事环境保护的法律体系显得尤为必要。本文以我国军事环境法的框架构建为核心,以期在法律制度方面对我国军事环境保护立法提供一些建议和对策。本文结合我国军事环境保护的实际情况,明确了军事环境法的概念和内涵,并通过分析我国军事环境法的立法现状,指出了我国虽然现在已经制定出相关的法规和条例,但由于缺乏科学完整、权威有效的法律体系,制约了我国军事环境保护工作的健康发展。在借鉴美国军事环境法重要经验的基础上,本文结合立法和组织制度层面完善我国军事环境法律体系,从立法上明确我国军事环境法的立法目的、立法依据和立法机关,从法律实施上,单独设立我国军事环境保护的主管机构和监督机制,从法律原则上特别创设军事活动与环境保护相协调原则,从法律制度上明确了军事环境法中环境影响评价、清洁生产和生态补偿等重要制度,从法律责任上确定了违反军事环境法应当承担的法律责任,并特别探讨了战时军事环境法的立法问题。
[Abstract]:Protecting the environment and realizing sustainable development have become the consensus and strong desire of people all over the world. Military environmental protection is an important part of national environmental protection. The environmental problems arising from military activities directly affect the overall benefits of national environmental protection. Therefore, it is necessary to strengthen the legislation of military environmental protection and perfect the legal system of military environmental protection. This paper focuses on the construction of the framework of military environmental law in order to provide some suggestions and countermeasures for the legislation of military environmental protection in our country in the aspect of legal system. Based on the actual situation of military environmental protection in China, this paper clarifies the concept and connotation of military environmental law, and points out that although our country has made relevant laws and regulations now, by analyzing the current legislative situation of military environmental law in China, However, the lack of scientific integrity and effective legal system restricts the healthy development of military environmental protection in China. On the basis of drawing lessons from the important experience of American military environmental law, this paper combines the legislative and organizational system to perfect our country's military environment legal system, and clarifies the legislative purpose, legislative basis and legislative organ of our country's military environmental law from the legislative point of view. In the aspect of law enforcement, the competent organs and supervision mechanism of military environmental protection in our country should be set up separately, the principle of coordination between military activities and environmental protection should be created in principle of law, and the environmental impact assessment in military environmental law should be made clear from the legal system. Some important systems, such as cleaner production and ecological compensation, determine the legal liability for violating military environmental law from the point of view of legal liability, and especially probe into the legislative issues of wartime military environmental law.
