我国地下水资源可持续利用法律制度研究

【摘要】： 随着我国经济的迅速发展,地下水资源面临严峻挑战,出现了严重超采导致的巨大的漏斗区以及大面积地下水体污染等严重问题。与此同时,开采地下水的力度还在加大,一些地方无节制的开采已经产生了严重的地质灾害,如地面沉降、海水入侵等,危害人民正常的生产生活秩序。目前,我国关于地下水资源的规定主要散见于《中华人民共和国水法》和《中华人民共和国水污染防治法》以及一些地方性法规和部门规章中,而且其规定比较原则、可操作性不强。为了达到地下水资源可持续利用的目的,实现社会、经济、环境的协调发展,应以预防原则、统一原则作为地下水资源管理的基本原则,确立地下水资源规划制度、取水许可证制度、评价制度以及功能区划制度,制定“地下水资源管理条例”。 本论文首先从介绍地下水资源相关概念出发,在总结了我国地下水资源的问题现状后,归纳我国现有的法律制度,并提出不足之处。然后介绍欧盟、美国、澳大利亚三国的先进立法经验。在第四部分则从立法理念、基本原则两个方面为地下水资源的基本制度的制定完善提供理论基础,最后则从建立完善法律制度以及完善配套法律制度配套制度两方面阐述我国的地下水资源法律制度,以达到我国地下水资源的可持续利用的目的。
[Abstract]:With the rapid development of China's economy, groundwater resources are facing severe challenges, and serious problems such as huge funnel areas caused by serious overmining and pollution of large areas of underground water bodies have emerged. At the same time, the intensity of groundwater exploitation is still increasing, and the unrestrained exploitation in some places has already produced serious geological disasters, such as land subsidence, seawater intrusion and so on, which endangers the normal order of production and life of the people. At present, the provisions on groundwater resources in China are mainly scattered in the Water Law of the people's Republic of China and the Water pollution Prevention and Control Law of the people's Republic of China, as well as in some local laws and regulations and departmental regulations. The maneuverability is not strong. In order to achieve the goal of sustainable utilization of groundwater resources and realize the harmonious development of society, economy and environment, the principles of prevention and unification should be taken as the basic principles of groundwater resources management, and the planning system of groundwater resources should be established. Water intake license system, evaluation system and functional regionalization system, the establishment of groundwater resources management regulations. This paper first introduces the concept of groundwater resources, summarizes the current situation of groundwater resources in China, summarizes the existing legal system of our country, and puts forward the deficiencies. Then introduce the advanced legislation experience of EU, USA and Australia. In the fourth part, it provides the theoretical basis for the establishment and perfection of the basic system of groundwater resources from the two aspects of legislative ideas and basic principles. Finally, the author expounds the legal system of groundwater resources in China from two aspects: establishing and perfecting the legal system and perfecting the supporting legal system, so as to achieve the purpose of sustainable utilization of the groundwater resources in China.
