陕北能源开发中环境保护法律对策研究

【摘要】：陕北的经济建设取得了长足的进步，但是经济的高速发展却伴随着环境状况的不断恶化。环境污染和生态破坏在不断的加剧。提高的物质生活水平和增长的人口，日益增大的人类对自然资源的需求，同时也日趋加剧的对环境的破坏。如何确保以最低的代价促使经济持续增长，同时还可持续利用自然资源，已成为当代所有国家在经济、社会发展过程中面临的一大难题。发展近20年，快速的陕北地区能源开发，，但是环境污染和资源消耗也进入了高峰期，如果能源开发诱发的环境污染得不到彻底治理，那么将从根本上失去能源开发所换取的经济发展意义。我们不仅应当认真研究资源禀赋的历史性、社会性、公正性和公益性，并且地方政府更应该高度重视。实现环境保护的目的，要让其长期持续的为经济的发展作出贡献，此举不但具有一定程度的理论意义，且也有很重要的现实意义。环境保护演变情况，也强调历史分析法的运用，力图运用历史与现实、理论与实践相结合的方法。在知识的运用上，鉴于环境保护问题的研究涉及多学科交叉性，必须吸收环境学、环境经济学、环境政治学和环境社会学的专业知识。本文以陕北能源开发中存在的问题为切入点，围绕环境生态破坏问题展开讨论。主要包括以下内容：第一章是导论，包括文章的研究背景、意义和方法，以及有关能源开发中环境保护的国内外研究综述和论文创新点等；第二章对陕北能源开发对环境造成的影响进行分析；第三章对陕北能源开发中环境问题产生原因进行剖析；第四章介绍域外环境保护法律制度对我国的启示。第五章介绍完善陕北能源开发中环境保护的法律对策。综上，通过对陕北能源开发中环境保护问题的研究，重视能源开发中的环境保护，使经济发展与环境保护协调起来，达到双赢的效果。
[Abstract]:The economic construction of northern Shaanxi has made great progress, but the rapid development of economy is accompanied by the deterioration of environmental conditions. Environmental pollution and ecological destruction are increasing. Improved material living standards and growing population, increasing human demand for natural resources, but also increasing damage to the environment. How to ensure sustained economic growth and sustainable use of natural resources at the lowest cost has become a major problem facing all countries in the process of economic and social development. During the past 20 years of development, the rapid development of energy resources in northern Shaanxi Province, but environmental pollution and resource consumption have also entered a peak period. If the environmental pollution caused by energy development is not thoroughly remedied, That will fundamentally lose the economic development of energy development in exchange for significance. We should not only study the history, sociality, fairness and public welfare of resource endowment, but also the local government should pay more attention to it. To achieve the goal of environmental protection, it is necessary to make a long-term and sustained contribution to the economic development, which not only has a certain degree of theoretical significance, but also has a very important practical significance. The evolution of environmental protection also emphasizes the application of historical analysis, trying to use the method of combining history and reality, theory and practice. In the application of knowledge, considering that the research of environmental protection involves the interdisciplinary nature, it is necessary to absorb the professional knowledge of environmental science, environmental economics, environmental politics and environmental sociology. In this paper, the problems existing in the development of energy resources in northern Shaanxi are taken as the starting point, and the problem of environmental ecological destruction is discussed. The main contents are as follows: the first chapter is the introduction, including the research background, significance and methods of the article, as well as the domestic and foreign research review and innovation points of environmental protection in energy development; The second chapter analyzes the impact of energy development on the environment in northern Shaanxi; the third chapter analyzes the causes of environmental problems in the development of energy resources in northern Shaanxi; the fourth chapter introduces the enlightenment of the extraterritorial legal system of environmental protection to China. The fifth chapter introduces the legal countermeasures to perfect the environmental protection in the energy development of northern Shaanxi. In summary, through the research on the environmental protection in the energy development of northern Shaanxi, we should pay attention to the environmental protection in the energy development so as to coordinate the economic development with the environmental protection, and achieve a win-win result.
