宠物动物福利法律问题研究

【摘要】： 近年来,随着人民生活水平的提高,我国宠物动物的数量迅猛增加,与此同时,宠物动物的生存状况也愈发引起人们的不安,特别是频繁出现的残酷虐待宠物动物的非道德行为,让越来越多的人关注宠物动物的福利问题。本课题研究的目的旨在通过探讨我国宠物福利领域理论和实践方面存在的诸多难题,并借鉴国外相关法律法规,为我国宠物福利立法探索出有益、可行的道路。促进我国宠物福利立法的早日实现。达到改善宠物的生存环境,解决社会争议问题和相关管理难题,促进公共卫生和大众健康事业的发展,最终达到人与宠物和谐相处的目的。 本文从动物福利的内涵和伦理基础出发,引出宠物动物福利的主题,并对宠物动物福利法的内涵作以概述。从三方面论述了我国宠物动物福利立法的必要性。一是宠物动物福利的现状堪忧。文中列举了多处具体事例,包括虐待、遗弃、野蛮运输、野蛮宰杀,制度迫害几个方面,需要立法促进其改善。二是由宠物动物引发的社会争议,管理难题需要相关立法有效规制。三是宠物动物行业的发展需要相关立法予以保障。第三部分提出我国宠物动物立法存在的不足,指出其在立法体系、立法目的、基本制度、监管体制以及法律责任等方面存在的问题。全方位的展示了我国某些城市宠物动物福利的发展现状和相关规章实际运行情况,由此阐述出问题的根本原因,为最终解决问题提供了方向。之后,简要评析了欧盟的宠物福利法,借鉴其先进的立法理念和较为完善的法律法规,在分析欧盟国家宠物福利法的过程中,总结出对我国宠物动物福利立法的重要启示,以指导我国的宠物动物福利立法。最后,从立法理念、立法应遵循原则、基本法律制度、监管体制以及法律责任五个方面对我国宠物动物福利立法进行了建设性的构想。
[Abstract]:In recent years, with the improvement of people's living standards, the number of pet animals in China has increased rapidly. At the same time, the living conditions of pet animals have become more and more disturbing. Especially the unethical behavior of cruelty and cruelty to pets makes more and more people pay attention to the welfare of pet animals. The purpose of this study is to explore the theoretical and practical problems in the field of pet welfare in China, and to explore a useful and feasible way for the legislation of pet welfare in China by referring to the relevant laws and regulations of foreign countries. To promote the early realization of pet welfare legislation in China. To improve the living environment of pets, to solve social disputes and related management problems, to promote the development of public health and public health, and finally to achieve the goal of harmony between people and pets. Based on the connotation and ethical basis of animal welfare, this paper introduces the theme of pet animal welfare and summarizes the connotation of pet animal welfare law. This paper discusses the necessity of legislation on pet animal welfare in China from three aspects. First, the status quo of pet animal welfare is worrying. Several specific examples are cited, including abuse, abandonment, barbaric transportation, barbaric slaughter and institutional persecution, which require legislation to improve them. The second is the social dispute caused by pet animals, management problems need to be effectively regulated by relevant legislation. Third, the development of pet animal industry needs to be protected by relevant legislation. The third part points out the shortcomings of pet animal legislation in China, and points out the problems in legislation system, legislative purpose, basic system, supervision system and legal liability. The development status of pet animal welfare in some cities of our country and the actual operation of relevant rules and regulations are shown in all directions, and the root cause of the problem is expounded, which provides the direction for the final solution of the problem. After that, the article briefly comments on the European Union's pet welfare law, draws lessons from its advanced legislation idea and more perfect laws and regulations, and summarizes the important enlightenment to our country's pet animal welfare legislation in the process of analyzing the European Union's pet welfare law. In order to guide our pet animal welfare legislation. Finally, the legislation of pet animal welfare in China is constructed from five aspects: the legislative idea, the principle, the basic legal system, the supervision system and the legal responsibility.
