我国排污收费法律问题研究

【摘要】： 从总体上看,我国目前的排污费征收范围还不是很广。在主体方面,对于自然人还没有纳入排污收费之范围;在排污费收费事项方面,目前只有对大气、海洋、水体、固体废物、噪声这五类污染因素征收排污费。目前我国排污费标准仅为实际排污治理费用的一半,使排污收费制度对促进排污者削减污染物排放的作用有限,因此,应根据排污收费标准高于或者至少等于治理成本的原则,对排污收费标准进行适度的调整。全国统一的排污费征收标准,它并不能够充分考虑到地方环境的特殊性。因此,在适度调整排污费征收标准时,应充分考虑区域环境条件差异。在排污费的征收过程中,要注重协调环境监察机构与环境监测机构的关系;同时,对排污费征收中的申报、审核、核定、征收、缴纳几个严密的征收程序,应该考虑到简化、优化,以体现出排污费征收行为的灵活性与合理性。新的收费制度针对过去排污费减免的随意性,强化了对排污费减免的法律控制,但是,繁琐的程序控制难以实现行政便民原则;同时,在排污费减免的实施过程中,法律的对于排污费减免的严格控制被逐步淡化。

In the main body, the natural person has not been included in the scope of sewage charges; in the matter of sewage charges, only the air, ocean, water, solid waste, noise, these five types of pollution factors levy sewage charges. At present, the standard of sewage charge in our country is only half of the actual cost of sewage treatment, so the effect of sewage charge system on promoting polluters to reduce pollutant discharge is limited. Therefore, according to the principle that the sewage charge standard is higher than or at least equal to the treatment cost, Appropriate adjustment of sewage charges. The national uniform sewage charge levy standard, it can not fully take into account the particularity of the local environment. Therefore, the regional environmental conditions should be fully taken into account when adjusting the standards of sewage charges. In the process of levying sewage charges, we should pay attention to the coordination of the relationship between environmental supervision agencies and environmental monitoring agencies; At the same time, in order to reflect the flexibility and rationality of the levying behavior of sewage charges, several strict collection procedures, such as declaration, examination, approval, collection and payment of sewage charges, should be considered for simplification and optimization. The new charging system strengthens the legal control of the exemption and relief of sewage charges in the past, but the cumbersome procedural control is difficult to realize the principle of administrative convenience; At the same time, in the process of sewage fee reduction, the strict control of sewage fee reduction is gradually desalinated.
