胶州湾湿地资源保护法律问题研究

【摘要】：近几年湿地资源的保护越来越受到人们的关注,特别是随着青岛市“环湾保护,拥湾发展”战略的实施,胶州湾湿地资源的保护问题已经引起了社会的思考,作者认为要解决目前胶州湾湿地资源存在的问题,最有效的办法就是通过法律手段来保护胶州湾湿地资源,文章通过对国外湿地资源保护的研究和对我国其他省份法律保护湿地资源的经验的借鉴,选定胶州湾湿地资源保护法律问题研究来作为研究对象。本文共有六部分组成,第一部分为导论,介绍了作者选题的意义。其中包括选题背景、研究意义等；研究现状包括国内外研究现状、文献综述等：研究方法与论文结构和论文的创新与不足。第二部分介绍了湿地的定义及其分类。第三部分是胶州湾湿地资源法律保护的背景,包括胶州湾湿地及其生态系统构成、胶州湾湿地资源的特点和胶州湾湿地资源保护综合评价。第四部分写的是加强胶州湾湿地资源法律保护的必要性,包括胶州湾湿地资源危机和胶州湾湿地资源的法制问题。第五部分介绍了胶州湾湿地资源法律保护的可行性,包括胶州湾湿地资源法律保护的政策基础、社会基础和法制基础。第六部分介绍了胶州湾湿地资源保护法律建议,文章在充分结合胶州湾湿地资源特点的基础上,通过借鉴国外及我国其他省份的法律保护经验,提出在立法、执法、司法方面加强保护的建议。
[Abstract]:In recent years, more and more attention has been paid to the protection of wetland resources, especially with the implementation of the strategy of "protection and development of surrounding bay" in Qingdao, the protection of wetland resources in Jiaozhou Bay has aroused social thinking. The author thinks that the most effective way to solve the problems existing in the wetland resources of Jiaozhou Bay is to protect the wetland resources of Jiaozhou Bay by legal means. Based on the study of foreign wetland resources protection and the experience of other provinces in China, this paper selects the study on the legal issues of wetland resources protection in Jiaozhou Bay as the research object. This paper consists of six parts, the first part is an introduction, which introduces the significance of the author's topic. It includes the background of the topic, the significance of the research, the status of the research at home and abroad, literature review, research methods and the structure of the paper and the innovation and shortcomings of the paper. The second part introduces the definition and classification of wetland. The third part is the background of the legal protection of Jiaozhou Bay wetland resources, including Jiaozhou Bay wetland and its ecosystem composition, the characteristics of Jiaozhou Bay wetland resources and comprehensive evaluation of Jiaozhou Bay wetland resources protection. The fourth part is about the necessity of strengthening the legal protection of wetland resources in Jiaozhou Bay, including the crisis of wetland resources in Jiaozhou Bay and the legal system of wetland resources in Jiaozhou Bay. The fifth part introduces the feasibility of legal protection of wetland resources in Jiaozhou Bay, including the policy basis, social foundation and legal basis of legal protection of wetland resources in Jiaozhou Bay. The sixth part introduces the legal suggestions of wetland resources protection in Jiaozhou Bay. On the basis of fully combining the characteristics of wetland resources in Jiaozhou Bay, the article puts forward legislation and law enforcement through drawing lessons from the experiences of foreign countries and other provinces in China. Recommendations to strengthen protection in the administration of justice.
