源头控制:农业面源污染防治的立法原则与制度中心

【摘要】:农业面源污染防治已成为世界范围内的难题,其污染源的高度分散性以及污染排放的时空不确定性,使得管理者很难确定具体的责任主体和责任分担,用于工业点源污染治理的制度工具对防治农业面源污染难以奏效。鉴于过程监控的难度和末端治理的滞后效应,从源头控制污染物的产生及其进入环境是防治农业面源污染的最佳对策。我国应将现行有关肥料和农药管理的法规、规章上升到法律层面,同时修订《水污染防治法》等相关法律,构建地方政府联动治理农业面源污染等机制,为顺利实施相关法律提供保障。
[Abstract]:Prevention and control of agricultural non-point source pollution has become a difficult problem in the world. The high dispersion of pollution sources and the space-time uncertainty of pollution emissions make it difficult for managers to determine the specific responsibility body and responsibility sharing. The system tool used for industrial point source pollution control is difficult to prevent agricultural non-point source pollution. In view of the difficulty of process monitoring and the lag effect of end control, it is the best countermeasure to prevent agricultural non-point source pollution from the source control of pollutant generation and its entry into the environment. China should raise the current laws and regulations on fertilizer and pesticide management to the legal level, at the same time revise the relevant laws such as the Water pollution Prevention and Control Law, and establish a mechanism for local governments to work together to control agricultural non-point source pollution. To ensure the smooth implementation of relevant laws.
