室内环境污染防治立法研究

【摘要】：近年来,随着我国经济的高速发展,人们生活水平也显著提高,也越来越注重豪华、舒适的室内生活环境,于是以追求豪华而忽略健康的室内装饰装修活动极为盛行。然而在大肆进行室内装饰装修的同时,我国的室内环境污染问题也越来越严重,这种新型的环境污染不仅会使民众遭受巨大的财产损失,而且会影响到民众的身体健康及生命安全。目前的室内环境污染致害状况凸显出立法的必要和迫切,而我国除了一些行政规章、地方性法规和相关室内环境标准外,在室内环境污染的立法方面还处于起步阶段,对室内环境污染的相关规定也多为原则性的,缺乏可操作性,致使法院在审理这种新型环境污染案件时只能依据《民法通则》、《环境保护法》和《消费者权益保护法》等法的规定,从而导致很多受害人的一些合法权益不能得到法律所应有的保障。然而,欧美国家早在20世纪90年代就已经开始制定防治室内环境污染的法规、规范、标准和指南,日本、韩国等国家及我国台湾地区也早已制定了成文的室内环境污染防治法,也取得了许多室内环境污染防治的有益经验。由此观之,在目前我国室内环境污染防治立法工作严重落后于室内环境污染危害的日益严重情形下,理应借鉴国外及我国台湾香港地区的先进立法、行政和司法实践经验,以及结合我国目前室内环境污染防治的立法现状及我国的环境立法传统,完善我国现有的室内环境污染防治的规范和制度,逐步建立适合我国国情的室内环境污染防治法律体系。本论文旨在通过对室内环境污染的概念、特点、危害和国内外室内环境污染防治立法现状的探索及总结来引出对我国室内环境污染防治的立法建议,以期对我国的室内环境污染防治法律体系的完善尽自己的微薄之力。笔者认为,目前环境权的勃兴和公民室内环境保护意识的提高为我国室内环境污染防治立法的进度提供了强有力的契机。我国应当在环境法的立法中将室内环境污染纳入到环境保护法的规制对象中,从而可以更好的保护公众的合法权益,为其享受舒适、健康、安全的室内环境创造条件。
[Abstract]:In recent years, with the rapid development of economy in our country, people's living standard has been improved significantly, and more attention has been paid to the luxurious and comfortable indoor living environment, so the indoor decoration and decoration activities, which pursue luxury but neglect health, are very popular. However, while decorating and decorating, the problem of indoor environmental pollution is becoming more and more serious in our country. This new type of environmental pollution will not only cause the people to suffer huge property losses. And it will affect the health and safety of the people. The current situation of indoor environmental pollution has highlighted the necessity and urgency of legislation. In addition to some administrative regulations, local regulations and related indoor environmental standards, the legislation of indoor environmental pollution is still in its infancy. The relevant regulations on indoor environmental pollution are mostly principled and lack of maneuverability. As a result, the courts can only rely on the "General principles of Civil Law" when trying cases of this new type of environmental pollution. The environmental protection law and the consumer rights and interests protection law and other laws lead to many victims' legitimate rights and interests can not be protected by the law. However, as early as the 1990s, European and American countries have begun to formulate laws, norms, standards and guidelines for the prevention and control of indoor environmental pollution. Japan, South Korea and other countries, as well as the Taiwan region of China, have already formulated written laws on the prevention and control of indoor environmental pollution. Also has obtained a lot of indoor environment pollution prevention and control beneficial experience. Therefore, under the situation that the legislation of indoor environmental pollution prevention and control in our country is lagging behind the harmfulness of indoor environmental pollution, we should learn from the advanced legislative, administrative and judicial experience of foreign countries and Taiwan and Hong Kong. Combined with the current legislative situation of indoor environmental pollution prevention and control in our country and the environmental legislative tradition of our country, the existing norms and systems of indoor environmental pollution prevention and control in China are improved. We will gradually establish a legal system for the prevention and control of indoor environmental pollution suited to China's national conditions. The purpose of this paper is to explore and summarize the concept, characteristics, harm and legislation status of indoor environmental pollution prevention and control at home and abroad in order to draw out the legislative suggestions on indoor environmental pollution prevention and control in China. In order to our country's indoor environmental pollution prevention and control legal system to do their own meager contribution. The author believes that the flourishing of environmental rights and the improvement of citizens' awareness of indoor environmental protection provide a powerful opportunity for the progress of legislation on prevention and control of indoor environmental pollution in China. In order to protect the legitimate rights and interests of the public, our country should bring the indoor environmental pollution into the regulation object of the environmental protection law in the legislation of environmental law, and create the conditions for them to enjoy comfortable, healthy and safe indoor environment.
