我国水权制度探析

【摘要】： 本文主要探讨了水权的法律性质及我国水权发展状况并对我国水权制度构建提出建议。本文由“引言、水权的基本概念、水权的基本内容与法律属性、我国水权制度现状、水权的转让、我国水权基本法律制度存在的问题及完善设想”六部分构成。引言部分通过对目前我国水资源状况以及存在问题的阐述引出论文研究目的及解决的问题。正文第一、二部分对水权的基本概念、内容与法律属性进行了分析,并对水权与水资源所有权、水权与土地使用权、相邻权等概念进行了探讨,明确了水权的用益物权属性。第三部分,论述了我国水权制度概况,对我国水权制度特点及管理体制进行分析。第四部分通过对水权转让的概述,提出建立水权市场必须允许水权转让。并对水权转让的条件、水权转让方式等进行阐述,对我国现有水权制度下典型水事案例进行实证分析,提出加快发展水市场、完善水权转让制度建议。第五部分,指出我国现行水权制度存在的问题：1.物权法虽规定水权为用益物权,但缺乏专门的规范。2.与水权配套的相关法规不完善。3.对侵害水权构成要件缺乏特别规定。并对我国构建水权物权立法提出设想：1.确定水权的立法模式,完善水权配套制度。2.明晰水权的私权性与公权性调整范围。3.明确水权与相邻排水权、地役权的关系。4.确立水权合同为有名合同。综上,随着我国经济和社会的发展,水和水相关的问题日益突出。解决我国水问题,就必须研究水权理论和实践,并在此基础上建立健全适合我国国情的水权法律制度,规范经济主体的用水行为,提高水资源的配置效率和使用效率。
[Abstract]:This paper mainly discusses the legal nature of water rights and the development of water rights in China, and puts forward some suggestions for the construction of water rights system in China. This paper is composed of six parts: introduction, basic concept of water right, basic content and legal attribute of water right, present situation of water right system, transfer of water right, problems existing in the basic legal system of water right of our country and perfect assumption. In the foreword part, the purpose of the research and the problems to be solved are brought forward by expounding the current situation of water resources and the existing problems in our country. The first and second parts of the text analyze the basic concept, content and legal attribute of water right, and discuss the concepts of water right and water resources ownership, water right and land use right, adjacent right and so on, and make clear the property of usufruct right of water right. In the third part, the general situation of water right system in China is discussed, and the characteristics and management system of water right system in China are analyzed. The fourth part puts forward that water right transfer must be allowed to establish water right market through the summary of water right transfer. The conditions of water rights transfer and the ways of water rights transfer are expounded. The typical water cases under the current water right system in China are analyzed empirically and suggestions are put forward to speed up the development of water market and perfect water rights transfer system. The fifth part points out the problems existing in the current water right system of our country: 1. Although the property law stipulates the water right as usufruct right, but lacks the special norm. 2. The related laws and regulations supporting water rights are not perfect. 3. Lack of special provisions on the constitutive elements of water rights infringement. And to our country constructs the water right real right legislation to propose the tentative plan: 1. Determine the legislative model of water rights, improve the supporting system of water rights. 2. Clear water rights of private rights and public rights to adjust the scope. 3. Clear water rights and adjacent drainage rights, easements. 4. Establish a water rights contract as a famous contract. In summary, with the economic and social development of China, water and water-related problems are increasingly prominent. In order to solve the water problem in China, we must study the theory and practice of water rights, and on this basis, we must establish and perfect the legal system of water rights suitable for the national conditions of our country, standardize the behavior of water use of economic subjects, and improve the efficiency of water resources allocation and utilization.
