环境影响评价制度中的利益衡量研究

【摘要】：在阐述利益及利益法学和环境影响评价制度基本理论的基础上，分析了我国环境影响评价制度在利益衡量程序与实体及实施效果方面存在的问题与不足，提出了引入社会理性和人文关怀的必要性，确立了环境影响评价制度实现公平正义的价值目标。结合环境影响评价的实践，，从利益与风险两个方面，对环境影响评价制度在个人、企业、区域及国家层面的利益影响进行了详细、全面的分析和梳理。在此基础上，对环境影响评价制度的公共利益与私人利益、公共利益之间、私人利益之间等利益关系进行了全景式的深刻解析。对利益衡量方法引入环境影响评价制度的必要性、可行性和局限性进行了细致分析，并对国外环境影响评价制度利益衡量的实践进行归纳和借鉴，由此，提出了我国环境影响评价制度利益衡量的三个具体原则。结合实际案例，运用利益位阶和经济分析法学理论对环境影响评价制度中的利益衡量方法进行定性和定量研究。最后，从利益衡量裁量基准、环境民主和利益救济等方面，提出完善环境影响评价制度利益衡量的各种机制和对策。
[Abstract]:On the basis of expounding the basic theories of interest and interest law and environmental impact assessment system, this paper analyzes the problems and shortcomings of the environmental impact assessment system in China in terms of the procedure and entity of interest measurement and the effect of its implementation. This paper puts forward the necessity of introducing social rationality and humanistic care, and establishes the value goal of environmental impact assessment system to realize fairness and justice. Combined with the practice of environmental impact assessment (EIA), this paper makes a detailed and comprehensive analysis and sorting out the benefit impact of EIA system at individual, enterprise, regional and national levels from two aspects: benefit and risk. On this basis, the relationship between public interest and private interest, between private interest and other interests of the environmental impact assessment system is deeply analyzed in a panoramic way. This paper analyzes in detail the necessity, feasibility and limitation of introducing the method of interest measurement into the system of environmental impact assessment, and sums up and draws lessons from the practice of interest measurement of the system of environmental impact assessment abroad. This paper puts forward three specific principles of interest measurement of environmental impact assessment system in China. In combination with practical cases, qualitative and quantitative research on the method of interest measurement in the environmental impact assessment system is carried out by using the level of interest and the theory of economic analysis law. Finally, it puts forward various mechanisms and countermeasures to improve the benefit measurement of environmental impact assessment system from the aspects of discretion standard of interest measurement, environmental democracy and benefit relief.
