环境保护公众参与法律制度研究

【摘要】： 在环境保护领域,人们把注意力投向政府和市场,但是政府作为“资源的权威性分配者”,担任着保护生态、治理环境的重任,在环境保护中发挥主导作用的同时,也很容易滥用权力,导致权力的虚置和回避,这种“政府失灵”的存在使得政府不能很好发挥环保的作用。市场是以追求个人利益的最大化为宗旨的,环境保护是以公众利益的保护为目标,这种价值利益的相悖,使得在环境保护领域,“市场失灵”的现象同样存在。在一个主张宪政国家的时代,公众的力量就应该得到充分的发挥,而我国环境保护公众参与制度还十分不完善,因此,在借鉴西方国家先进经验的基础上,结合我国实际,建构和完善我国环境保护公众参与法律制度是十分重要且有意义的。 本文分为三章:第一章主要介绍了环境保护公众参与的内涵与功能。第二章主要介绍了我国环境保护公众参与法律制度的现状及国外环境保护公众参与法律制度先进的经验。第三章主要介绍了我国环境保护公众参与法律制度完善的社会基础,在此基础上,提出了完善我国环境保护公众参与法律制度的措施,包括:环境保护公众参与立法体系的完善;环境信息知情制度的完善;环境立法、行政决策、执法监督过程中公众参与制度的健全;环境公益诉讼制度的建立;社团参与环境保护法律制度的完善。
[Abstract]:In the field of environmental protection, people pay attention to the government and the market, but the government, as the "authoritative distributor of resources", plays an important role in protecting the ecology and governing the environment, and at the same time plays a leading role in the protection of the environment. It is also easy to abuse power, leading to the false and evasive power, the existence of this "government failure" makes the government can not play a good role in environmental protection. The purpose of the market is to pursue the maximization of personal interests, and the protection of the environment is aimed at the protection of public interests. The contradiction of this value interest makes the phenomenon of "market failure" also exist in the field of environmental protection. In an era of advocating constitutionalism, the public power should be brought into full play, and the system of public participation in environmental protection in our country is still very imperfect. Therefore, on the basis of drawing lessons from the advanced experience of western countries, and combining with the reality of our country, It is very important and meaningful to construct and perfect the legal system of public participation in environmental protection in China. This paper is divided into three chapters: the first chapter mainly introduces the connotation and function of public participation in environmental protection. The second chapter mainly introduces the present situation of China's environmental protection public participation legal system and the advanced experience of foreign countries' environmental protection public participation legal system. The third chapter mainly introduces the social foundation of China's environmental protection public participation in the legal system, on this basis, puts forward the measures to improve the environmental protection public participation in the legal system. Including: environmental protection public participation in the legislative system; The perfection of the environmental information informed system; the perfection of the public participation system in the process of environmental legislation, administrative decision-making, law enforcement supervision; the establishment of the environmental public interest litigation system; the perfection of the legal system of community participation in environmental protection.
