主体功能区管理环境法问题研究

【摘要】：国家《“十一五”规划纲要》提出的主体功能区制度是我国区域发展战略的重要制度,是我国区域经济理论和实践的重大创新,将会长期、全面的影响着我国区域经济社会的发展,尤其是对我国现有法律,特别是对环境资源保护法带来深远的影响。正是基于此,本文以环境法的视角对主体功能区域管理问题进行探讨,主要采用了比较分析、综合分析、实证分析和文献资料的方法,从主体功能区相关概念内涵、理论基础、环境政策入手,结合我国主体功能区环境法的现状,对主体功能区和区域环境问题进行剖析,充分借鉴国外空间规划的相关经验,完善主体功能区的环境法律制度,以便在主体功能区建设过程中做到有法可依,更好地促进区域统筹协调发展、促进主体功能区战略的实施。主体功能区的实施需要法律来保障。本文研究这一课题的理论意义在于通过借鉴国外空间规划理论和实践的成果,构建主体功能区环境管理的法律体系,修改和完善现行环境法以期达到与主体功能区的高度契合,从而对进一步缓解我国区域性资源环境矛盾冲突日益尖锐的问题,促进区域协调和可持续发展、缩小地区差距、优化区域环境管理体制具有现实意义。本文通过对国内相关主体功能区划的研究和对国外空间发展规划的经验、特点梳理总结的基础上,以主体功能区建设为主线对区域环境法的完善进行探讨。本文主要内容包括以下四个部分：第一部分,主要从基础理论和环境政策指引两方面对主体功能区环境基本问题进行分析。理论方面包括辨析主体功能区相关概念、剖析主体功能区的内涵和研究主体功能区环境管理的理论支撑依据,并明确主体功能区的划分标准和依据。环境政策指引方面分别阐述了四类主体功能区的环境政策。通过这一部分的阐述为下文的研究提供理论支撑。第二部分,主要对我国主体功能区环境法的现状进行分析。首先分析了我国目前区域环境存在的问题及主体功能区的管理现状；其次是通过梳理主体功能区与自然资源法和污染控制法的衔接,对主体功能区域环境立法现状进行了总结。第三部分,主要论述了发达国家空间规划的经验及对我国的启示。本文综述了德国、荷兰、欧盟、日本、美国等发达国家空间规划的经验,分别归纳了各国空间规划的特点,在此基础上分析国外空间规划对我国主体功能区环境管理的启示。第四部分,主要阐述了主体功能区环境法制完善的思考。本文结合我国目前环境法的立法现状,借鉴国外发达国家空间规划的经验,提出了完善我国主体功能区环境法制的建议。最后本文得出结论认为,为了促进主体功能区制度与环境法律制度相协调、相配合,我国主体功能区环境法制的建设必须充分吸收借鉴国外发达国家空间规划的经验,健全和完善有关主体功能区的环境法律法规,建立跨行政区域协调发展的体制机制,在主体功能区规划编制和实施的过程中强调公民的广泛参与,在规划实施过程中强化地方政府环保责任,为主体功能区建设提供环境法律保障。
