我国城市生活垃圾污染防治立法问题研究

【摘要】： 随着经济的飞速发展,人口数量的快速增加,城市化进程的不断加快,城市生活垃圾的产生量也与日俱增,不仅污染环境,也浪费了资源。目前城市生活垃圾污染防治问题成为困扰世界各国的重大问题,因此怎样从法律层面来构建我国城市生活垃圾的管理体制和完善我国城市生活垃圾污染防治立法就成为政府和民众关注的焦点。本文同时结合研究美国、德国、日本以及韩国在城市生活垃圾污染防治立法与实践方面的先进经验,探讨了我国城市生活垃圾污染防治立法存在的问题,并有针对性地提出了完善我国城市生活垃圾污染防治立法的建议,具体包括:建立城市生活垃圾回收处理收费制度;明确减量化、资源化的立法方向;制定资源综合利用基本法及其配套法规。
[Abstract]:With the rapid development of economy, the rapid increase of population and the acceleration of urbanization, the production of municipal solid waste is increasing day by day, which not only pollutes the environment, but also wastes resources. At present, the prevention and control of municipal solid waste pollution has become a major problem perplexing countries all over the world. Therefore, how to construct the management system of municipal solid waste from the legal level and perfect the legislation of prevention and control of municipal solid waste pollution has become the focus of attention of the government and the public. Combined with the advanced experiences of the United States, Germany, Japan and South Korea in the legislation and practice of municipal solid waste pollution prevention and control, this paper discusses the problems existing in the legislation of municipal solid waste pollution prevention and control in China. At the same time, some suggestions are put forward to improve the legislation of municipal solid waste pollution prevention and control in China, including: establishing the charging system of municipal solid waste collection and disposal; Make clear the legislative direction of reducing and resourcing, and formulate the basic Law of Comprehensive Utilization of Resources and its supporting laws and regulations.
