我国光污染防治立法研究

【摘要】： 随着我国社会经济与城市建设的迅速发展,光在带给人们便利的同时,也危害着人类生存的环境。光污染是继废气、废水、废渣和噪声污染之后的一种新型环境污染。光污染不仅威胁着人类健康、而且还危害动植物的生存和繁衍,并且其危害程度呈现逐年加剧的趋势。在光污染侵害案件日益增多的同时,我国光污染侵害的法律救济手段和救济措施的效果却不尽人意。因此,为了更为有效地防治光污染,维护受害人的合法权益,我国有必要进一步制定和完善光污染防治立法。 光污染是指人类的活动对各种光线处置不当,从而导致危害人体健康,以及破坏自然生态系统,造成环境质量恶化的现象。目前,我国的光污染问题越来越严重,究其原因,就在于光污染防治的立法缺失、监管不到位、制度不健全、法律责任不明确等。为了有效地防治光污染,必须从我国的国情出发,借鉴国外光污染防治立法经验,在继承完善我国现有制度的基础上,建立我国的光污染防治立法体系。从而用法律来有效地保护、改善生活环境和生态环境,保障人类的健康与安全。
[Abstract]:With the rapid development of social economy and urban construction, light not only brings convenience to people, but also endangers the environment of human existence. Light pollution is a new type of environmental pollution after waste gas, waste water, waste residue and noise pollution. Light pollution not only threatens human health, but also endangers the survival and reproduction of animals and plants. While the cases of light pollution infringement are increasing day by day, the legal remedy and relief measures of light pollution infringement in our country are not satisfactory. Therefore, in order to prevent and control light pollution more effectively and protect the legitimate rights and interests of victims, it is necessary for our country to further formulate and perfect the legislation of light pollution prevention and control. Light pollution refers to the improper disposal of all kinds of light by human activities, which leads to the harm to human health, the destruction of natural ecosystem, and the deterioration of environmental quality. At present, the problem of light pollution is becoming more and more serious in our country. The reason lies in the lack of legislation, supervision and supervision, imperfect system, unclear legal responsibility and so on. In order to prevent and control light pollution effectively, it is necessary to set up the legislation system of light pollution prevention and control in our country on the basis of inheriting and perfecting the existing system of our country, starting from the national conditions of our country and drawing lessons from the legislative experience of light pollution prevention and control abroad. In order to effectively protect and improve the living environment and ecological environment by law, to protect human health and safety.
