山西省城市生态环境保护法律问题研究

【摘要】： 城市生态环境是支撑一个城市快速发展的基石。但是,在城市发展的过程中我们要面对城市生态环境遭到破坏的现实。良好的城市生态环境不仅有利于城市的可持续发展,还会提高生活在这个城市中的居民的生活质量和生活水平。由于山西省是我国的能源化工业大省,很多城市的发展大多是依赖重工业发展起来的。因此,在山西省城市化过程中,城市生态环境受到破坏的情况比较严峻,城市化的进程和发展速度因为生态环境的破坏而进展缓慢,城市生态问题引起了关注,山西省也正在为此做出很大的努力。山西省在城市发展中生态比较脆弱,应对生态问题的能力也较差,所以城市生态环境很容易受到破坏,这是人类中心主义在城市发展中对生态环境破坏的后果。山西省在城市发展过程中必然要对城市生态进行恢复,城市生态恢复是城市发展过程的必由之路。国外关于城市生态环境保护方面的法律已经比较成熟,而且效果显著,这为山西省城市生态环境保护提供了一个很好的参考与借鉴。笔者在借鉴国外城市发展过程中成功的经验,同时考虑到山西省城市生态环境的实际情况,对山西省城市生态环境保护提出要充分提高山西省城市生态环境保护法律的科学性和立法质量,在制定城市生态环境保护地方性法规、规章时应遵循自然恢复和人工恢复相结合的原则,并且要在此基础上建立山西省城市生态恢复工程维护机制等观点和建议。山西省关于城市生态环境保护方面的法律文件不够完善,以至于不能发挥法律在保护城市生态环境方面的作用。城市生态环境保护应当在以后山西省制定法律时重点予以关注。只有将城市生态环境保护纳入到法律保护的范畴之内,城市生态环境才能可持续的发展。
[Abstract]:Urban ecological environment is the cornerstone of supporting the rapid development of a city. However, in the process of urban development, we have to face the reality that the urban ecological environment has been destroyed. A good urban ecological environment is not only conducive to the sustainable development of the city, but also improves the quality of life and living standards of the residents living in the city. Because Shanxi Province is a big province of energy and chemical industry in China, the development of many cities depends on heavy industry. Therefore, in the process of urbanization in Shanxi Province, the destruction of urban ecological environment is more serious, the process and development speed of urbanization is slow because of the destruction of ecological environment, and the urban ecological problem has attracted attention. Shanxi Province is also making great efforts to this end. Shanxi Province is fragile in urban development and has poor ability to deal with ecological problems, so the urban ecological environment is easy to be destroyed, which is the consequence of the destruction of ecological environment by humanitarianism in urban development. In the process of urban development, Shanxi Province must restore the urban ecology, and the urban ecological restoration is the only way in the process of urban development. The foreign laws on urban ecological environment protection have been relatively mature, and the effect is remarkable, which provides a good reference and reference for the protection of urban ecological environment in Shanxi Province. The author draws lessons from the successful experience in the process of urban development in foreign countries, and at the same time takes into account the actual situation of urban ecological environment in Shanxi Province. For the protection of urban ecological environment in Shanxi Province, it is necessary to fully improve the scientific nature and legislative quality of the law on urban ecological environment protection in Shanxi Province, and to formulate local laws and regulations for the protection of urban ecological environment. The rules and regulations should follow the principle of combining natural restoration with artificial restoration, and on this basis, the maintenance mechanism of urban ecological restoration project in Shanxi Province should be established. The legal documents on the protection of urban ecological environment in Shanxi Province are not perfect enough to play the role of law in the protection of urban ecological environment. The protection of urban ecological environment should be paid more attention to when Shanxi Province formulates the law in the future. Only by bringing the protection of urban ecological environment into the scope of legal protection can the urban ecological environment develop sustainably.
