中国机场噪声污染防治立法问题研究

【摘要】：当前中国机场噪声污染问题较为严重,造成该问题的主要原因之一是相关立法起步晚、发展慢、不健全,使得机场噪声污染防治工作缺乏切实有效的法律规定可依。为解决此问题,当务之急是整合现有相关规定,借鉴国际通行做法,考虑中国现实国情,构建由"原则规定—基本制度—配套规则"组成的机场噪声污染防治法律制度体系。这其中又以确立与完善合理规划制度、机场噪声监测制度、机场减噪收费制度等基本制度为重点。
[Abstract]:At present, the problem of airport noise pollution in China is more serious. One of the main reasons for this problem is that the relevant legislation starts late, develops slowly and is not perfect, which makes the prevention and control of airport noise pollution lack of effective legal provisions. In order to solve this problem, it is urgent to integrate the existing relevant regulations, draw lessons from international practices, consider the actual national conditions of China, and construct the legal system of airport noise pollution prevention and control, which is composed of "principles and regulations-basic system-supporting rules". This also focuses on the establishment and improvement of reasonable planning system, airport noise monitoring system, airport noise reduction charge system and other basic systems.
