我国环境行政奖励制度研究

【摘要】： 当前,我国环境保护的国家意志达到空前高度,明确而坚定的加强环境保护的政治基础已经基本形成,建设“资源节约型、环境友好型社会”被确定为国民经济与社会发展中长期规划的一项战略任务。但与此同时,环境问题日益严峻,整治力度不断加大,环境问题自身的复杂性、多变性和长期性导致传统的环境行政手段未能充分发挥作用。在这种现实局面下,环境行政奖励制度因其自身的激励特性、人文精神和民主色彩就焕发出了勃勃的生机和活力,彰显着自己独特的引导作用。环境行政奖励制度通过对受奖人环境行为的肯定与褒扬,引导和驱使环境行政相对人主动实施一定的行为,有利于减少摩擦和纠纷,缓解对抗情绪,降低环境保护成本。研究环境行政奖励制度,有利于促进人与自然的和谐共生,有利于构建社会主义和谐社会。 本文主要运用了辨证分析方法、实证分析方法和比较方法,辩证的分析了我国环境行政奖励制度的一些基本理论问题,并通过与其他国家的典型环境行政奖励制度的分析比较构筑适合我国国情的环境行政奖励制度。本文从社会学、经济学、法学和心理学四个角度深入阐述了环境行政奖励制度的理论基础,建立了一个坚实的理论体系,为环境行政奖励制度存在的合理性和必要性提供了强大的理论支撑。我国环境行政奖励制度存在的问题及如何构建都紧紧围绕制度的三个构成要素——“正式规则”、“非正式规则”以及这些规则的执行机制分别从理论研究、立法实践和执行实施的角度具体、系统的深入展开和探析,这两点是本文的创新之处。本文旨在通过对我国环境行政奖励制度基本问题的深入阐析,探索新形势下新型的环境行政手段,加强环境行政奖励制度的理论研究和实践探索,为新时期的环境保护工作服务。
[Abstract]:At present, the national will of environmental protection in our country has reached an unprecedented height, and the clear and firm political basis for strengthening environmental protection has been basically formed. Building a "resource-saving, environment-friendly society" has been determined as a strategic task in the medium-and long-term planning of national economic and social development. However, at the same time, the environmental problems are becoming more and more serious, the intensity of rectification is increasing, and the complexity, variability and long-term nature of the environmental problems themselves lead to the failure of the traditional environmental administrative means to play a full role. In this realistic situation, the environmental administrative reward system, because of its own incentive characteristics, humanistic spirit and democratic color coruscate vitality and vitality, showing its own unique guiding role. Through the affirmation and praise of the environmental behavior of the recipient, the environmental administrative reward system guides and drives the environmental administrative counterpart to carry out certain behavior actively, which is beneficial to reduce friction and disputes, alleviate antagonistic emotion and reduce the cost of environmental protection. The study of environmental administrative reward system is helpful to promote the harmonious symbiosis between man and nature and to build a harmonious socialist society. This paper mainly uses dialectical analysis method, empirical analysis method and comparative method to dialectically analyze some basic theoretical problems of environmental administrative reward system in China, and construct an environmental administrative reward system suitable for the national conditions of our country through the analysis and comparison with the typical environmental administrative reward system in other countries. This paper expounds the theoretical basis of environmental administrative reward system from four angles of sociology, economics, law and psychology, and establishes a solid theoretical system, which provides a strong theoretical support for the rationality and necessity of the existence of environmental administrative reward system. The problems existing in the environmental administrative reward system in our country and how to construct it all revolve around the three constituent elements of the system-"formal rules", "informal rules" and the enforcement mechanism of these rules, respectively, from the perspective of theoretical research, legislative practice and enforcement, systematic development and analysis, which are the innovations of this paper. The purpose of this paper is to explore the new environmental administrative means under the new situation, to strengthen the theoretical research and practical exploration of the environmental administrative reward system, and to serve the environmental protection work in the new period through the in-depth analysis of the basic problems of the environmental administrative reward system in our country.
