我国野生动物保护法律制度完善研究

【摘要】：野生动物是生态环境的重要组成部分,不仅具有重要的经济、科学和文化价值,而且对于维护生态平衡具有重要意义。我国地域辽阔、自然条件复杂、生态环境各异,适应多种野生动物的生存,是世界上野生动物资源最为丰富的国家之一。但是我国乱捕乱杀野生动物,非法进行野生动物贸易等现象从未停息过,致使我国野生动物资源遭到严重破坏。随着对野生动物研究的不断深入,人们逐渐认识到野生动物保护的重要性,国家试图通过立法和制定相关制度加强对野生动物的保护,但在现实中却存在一些问题。 本文试图完善我国的野生动物保护法律制度。首先,通过对我国野生动物保护概况的剖析,明确了野生动物的法律内涵和我国保护野生动物的思想,并对野生动物保护的理论基础进行了阐述；其次,对国际野生动物保护立法进行对比研究,找出我国野生动物保护立法的不足之处,探讨出国际立法对我国野生动物保护法律制度的借鉴所在；最后,通过对我国野生动物保护的现状和存在的问题的分析,提出完善我国野生动物保护法律制度的建议。以期能够建立健全我国野生动物保护法律制度,解决我国现实中野生动物保护法律制度存在的问题,从而能更好地保护我国的野生动物。
[Abstract]:Wildlife is an important part of ecological environment, which not only has important economic, scientific and cultural value, but also plays an important role in maintaining ecological balance. China has a vast territory, complex natural conditions and different ecological environment, so it is one of the most abundant wildlife resources in the world to adapt to the survival of a variety of wild animals. However, the phenomenon of random hunting and killing of wild animals and illegal wildlife trade in China has never stopped, resulting in serious damage to wildlife resources in China. With the deepening of wildlife research, people gradually realize the importance of wildlife protection. The state tries to strengthen the protection of wildlife through legislation and formulation of relevant systems, but there are some problems in reality. This paper attempts to improve the legal system of wildlife protection in China. First of all, through the analysis of the general situation of wildlife protection in China, this paper clarifies the legal connotation of wildlife and the thought of protecting wild animals in China, and expounds the theoretical basis of wildlife protection. Secondly, it makes a comparative study of international wildlife protection legislation, finds out the shortcomings of China's wildlife protection legislation, and probes into the reference of international legislation to the legal system of wildlife protection in China. Finally, through the analysis of the present situation and existing problems of wildlife protection in China, some suggestions are put forward to improve the legal system of wildlife protection in China. In order to establish and improve the legal system of wildlife protection in our country, solve the problems existing in the legal system of wildlife protection in our country, so as to better protect the wild animals in our country.
