我国森林资源物权法律制度研究

【摘要】： 森林作为重要的陆地生态系统主体,是构成自然生态环境的基本自然物质要素,具有生态价值、经济价值、精神价值、社会价值等多方面的价值。为了保障森林资源的永续利用,维护森林生态平衡,我国已经基本上建立起包括《中华人民共和国宪法》、《中华人民共和国物权法》、《中华人民共和国森林法》、《中华人民共和国森林法实施条例》等法律的森林资源物权法律体系。近年来,林业和森林资源状况发生了巨大的变化,我国森林资源物权法律制度已经出现立法滞后、体系混乱等诸多问题,已经不能适应新情况的需要。完善森林资源物权法律制度,促进森林资源的利用、保护和发展,已经迫在眉睫。本文阐述了我国森林资源物权法律制度的体系和内容,分析了我国森林资源物权法律制度存在的问题,并对其完善和发展的途径进行了探讨,希望对完善我国森林资源物权法律制度有所裨益。本文从结构上一共分为三大部分。第一章为森林资源物权基本范畴,主要对森林、森林资源及森林资源物权进行基本理论介绍；第二章为森林资源物权基本制度,根据物权的分类方法,结合森林资源物权法律规定,分别介绍森林资源物权所有权制度、用益物权制度、担保物权制度以及森林资源物权流转制度；第三章为森林资源物权法律制度的问题及完善,在总结概括森林资源物权法律制度存在问题的基础上,从完善森林资源物权法律体系规范立法技术、明确所有权主体、完善物权权能、完善物权流转制度、实施森林分类经营制度、完善生态效益补偿制度等角度对森林资源物权制度的完善提出了建议。
[Abstract]:Forest, as an important subject of terrestrial ecosystem, is the basic natural material element of natural ecological environment, which has many values, such as ecological value, economic value, spiritual value, social value and so on. In order to ensure the sustainable utilization of forest resources and maintain the balance of forest ecology, our country has basically established the real right legal system of forest resources, including the Constitution of the people's Republic of China, the property Law of the people's Republic of China and the regulations of the implementation of the Forest Law of the people's Republic of China. In recent years, great changes have taken place in forestry and forest resources. There have been many problems in the legal system of real rights of forest resources in China, such as lagging legislation, chaotic system and so on, which can no longer meet the needs of the new situation. It is urgent to perfect the legal system of real right of forest resources and promote the utilization, protection and development of forest resources. This paper expounds the system and content of the legal system of real right of forest resources in our country, analyzes the problems existing in the legal system of real right of forest resources in our country, and probes into the ways of its perfection and development, hoping to be beneficial to the perfection of the legal system of real right of forest resources in our country. This paper is divided into three parts in terms of structure. The first chapter is the basic category of real right of forest resources, which mainly introduces the basic theory of forest, forest resources and real right of forest resources, the second chapter is the basic system of real right of forest resources, according to the classification method of real right, combined with the legal provisions of real right of forest resources, the system of real right ownership of forest resources, the system of usufruct right, the system of real right of security and the circulation system of real right of forest resources are introduced respectively. The third chapter is the problems and perfection of the real right legal system of forest resources. On the basis of summing up the existing problems of the real right legal system of forest resources, this paper puts forward some suggestions on the perfection of the real right system of forest resources from the angles of perfecting the legal system of real right of forest resources, standardizing the legislative technology, defining the subject of ownership, perfecting the power of real right, perfecting the circulation system of real right, implementing the system of forest classified management, and perfecting the system of ecological benefit compensation.
