我国农村饮用水安全的立法研究

【摘要】： 饮用水安全关系着人类的健康与生命。由于受社会经济发展水平及自然条件等多方面因素的影响,农民往往提取地表层的水饮用。随着农村环境污染的加剧,我国大多数农村地区的饮用水安全状况令人担忧,少数地区的饮用水污染已经危机到人们的健康。我国农村人口占全国人口的70%,农村地区饮用水安全直接关系到我国整体饮用水安全问题的进程和水平。作为新农村建设中的重要环节,解决农村饮用水安全问题刻不容缓。 本文的研究共分为五个部分。第一部分“绪论”。简要地阐述了本文的研究背景、研究问题的提出及研究目的和意义；第二部分“加强农村饮用水安全立法的必要性”。从保障生态安全、保障农民的人权和农村可持续发展三个方面分析了农村饮用水安全立法的必要性；第三部分“我国农村饮用水保护立法的法学基础”。以法理学和环境法学为理论基础,对立法指导思想进行分析,为完善我国农村饮用水立法提供理论支持;第四部分“我国农村饮用水的立法现状及问题分析”。归纳有关我国农村饮用水的法律法规,通过分析找出立法的漏洞和法律制度的缺陷；第五部分“我国农村饮用水保护立法的完善和健全”。在前面分析的基础上,以我国新农村建设的指导方针和政策为指导,以法理和环境法学为理论依据,结合我国农村饮用水国情,为改善和解决农村饮用水安全问题提出了法律对策。 农村饮用水安全不仅关系着农民的生命健康,关系着农村地区的经济可持续发展,更关系着我国新农村建设重大目标的实现。因此,完善和制定关于农村水饮用水安全保护的法律,具有很强的现实和理论意义：一方面为我国农村地区饮用水安全保护提供法律依据,改善农民生活质量；另一方有利于实现农村地区经济、环境的协调发展,加快我国新农村建设的进程,促进“和谐社会”目标的实现。
[Abstract]:Drinking water safety is related to human health and life. Due to the influence of many factors, such as the level of social and economic development and natural conditions, farmers often extract the surface water to drink. With the aggravation of rural environmental pollution, the safety of drinking water in most rural areas of China is worrisome, and drinking water pollution in a few areas has been in crisis to people's health. The rural population in China accounts for 70% of the national population. Drinking water safety in rural areas is directly related to the process and level of the overall drinking water safety problem in China. As an important link in the construction of new countryside, it is urgent to solve the problem of drinking water safety in rural areas. The research of this paper is divided into five parts. The first part is the introduction. This paper briefly expounds the research background, the putting forward of the research problems and the purpose and significance of the research. The second part is "the necessity of strengthening the legislation of drinking Water Safety in Rural areas". This paper analyzes the necessity of rural drinking water safety legislation from three aspects: ensuring ecological security, ensuring farmers' human rights and rural sustainable development. The third part is "the legal basis of Rural drinking Water Protection legislation in China". Based on the theories of jurisprudence and environmental law, this paper analyzes the guiding ideology of legislation, and provides theoretical support for perfecting the legislation of rural drinking water in China. The fourth part is "Analysis of the present situation and problems of rural drinking water legislation in China". This paper sums up the laws and regulations about rural drinking water in our country, and finds out the loopholes in the legislation and the defects of the legal system through the analysis. The fifth part is "the perfection and perfection of the legislation of rural drinking water protection in our country". On the basis of the previous analysis, under the guidance of the guidelines and policies of the new rural construction in China, based on the theory of law and environmental law, combined with the national conditions of rural drinking water in China, this paper puts forward some legal countermeasures to improve and solve the problem of drinking water safety in rural areas. The safety of drinking water in rural areas is not only related to the life and health of farmers, but also to the sustainable development of economy in rural areas, but also to the realization of the major goals of new rural construction in China. Therefore, it is of great practical and theoretical significance to perfect and formulate the law on the safety and protection of drinking water in rural areas of our country: on the one hand, it provides the legal basis for the safe protection of drinking water in rural areas of our country and improves the quality of life of farmers; on the other hand, it is beneficial to realize the coordinated development of economy and environment in rural areas, speed up the process of new rural construction in our country, and promote the realization of the goal of "harmonious society".
