【摘要】：基于配偶身份而产生的夫妻家事代理权，是调整夫妻人身关系的重要制度，在我国现行婚姻法中尚未明确规定。这一制度起源于罗马法，后被许多西方资本主义国家所继受。笔者经过论证分析认为夫妻家事代理权是一种特殊的代理，与一般代理有许多异同，但一般代理的基本原理同样适用于夫妻家事代理。其主体应仅限于具有合法夫妻关系的夫妻双方，对其适用范围宜采用列举性规定和排除性事项的综合方式规定。为了防止一方滥用或逾越夫妻家事代理权，另一方可进行限制，但这一限制原则上不能对抗善意第三人。 本文引言引出要论述的主题。正文有四部分，第一部分对夫妻家事代理权基本问题的探讨。包括其性质、含义、特征及其适用范围等；第二部分是对夫妻家事代理权的比较法考察。通过对大陆法系国家和英美法国家和地区的夫妻家事代理制度的考察，，为将来我国立法提供借鉴；第三部分从立法和司法实践方面对我国夫妻家事代理权的现状进行分析，明确存在的问题。第四部分通过对设立家事代理权的价值分析，对完善我国夫妻家事代理制度提出具体立法建议。结语是对全文的概括总结。
[Abstract]:Based on the status of spouse, the right of family agency is an important system to adjust the personal relationship between husband and wife, which has not been clearly stipulated in the current marriage law of our country. This system originated in Roman law. After being accepted by many western capitalist countries, the author thinks that the right of family agency is a special kind of agency, which has many similarities and differences with general agency. However, the basic principle of general agency is also applicable to the family agency of husband and wife. The subject should be limited to the husband and wife who have the legal relationship between husband and wife. In order to prevent one party from abusing or exceeding the power of agency of husband and wife, the other party may restrict it. But this restriction does not, in principle, stand against bona fide third parties. There are four parts in the text. The first part discusses the basic problems of the agency right of husband and wife family affairs, including its nature, meaning, characteristics and applicable scope. The second part is a comparative study of the right of family agency. Through the investigation of the civil law countries and the Anglo-American law countries and regions of the family agency system, it can provide reference for the future legislation of our country. The third part from the legislative and judicial practice of the analysis of the current situation of family agency in China, clear problems. 4th through the establishment of family agency value analysis. The conclusion is a summary of the full text.
