【摘要】：婚姻不仅是家庭的基础，也是感情和物质融合的产物。在婚姻关系存续期间，夫妻可能会接受婚外第三方的赠与，如父母对子女的房产赠与；或者夫妻一方接受夫妻另一方的赠与，如夫妻之间的互相赠与。这些赠与行为在稳定家庭关系，促进夫妻感情等方面有着重要的作用。但是在离婚率居高不下的当今社会，一旦夫妻感情破裂，离婚收场，赠与财产的归属便又可能引发新的纠纷。尽管我国《婚姻法》及其司法解释对夫妻受赠的财产特别是房产的归属情况有了较为明确的规定，但这些规定颇受争议。明确受赠物的归属才能定纷止争，防范婚姻家庭矛盾，而要准确地界定受赠物的归属，则需要对我国婚姻家庭状况、夫妻财产制度、赠与制度等有充分的了解，并且可以很好地平衡各方的利益，权衡利弊。本文拟在厘清婚内受赠类型、阐述与婚内受赠相关的赠与制度、夫妻财产制度的基础上，针对我国相关法律及其司法解释，对两种典型的婚内受赠物的归属予以探讨，并提出完善建议。本文共分为四章，，第一章对婚内受赠的基本情况予以阐述，包括概念、特征、受赠物的范围、种类等。第二章主要阐述婚内受赠与一般赠与的关系，着重讨论了一般赠与的任意撤销制度，因为最新的《婚姻法〈司法解释（三）〉》第6条规定夫妻之间的房产赠与可以适用一般赠与合同的任意撤销制度，引发争议，因此有必要对任意撤销制度予以关注。第三章阐述了婚内受赠与夫妻财产制度的关系。夫妻一方或双方接受赠与必然会导致个人财产或者共同财产的变化，而这变化与夫妻财产制度有着密切的关系。第四章主要介绍我国《婚姻法》及其司法解释关于两种最典型的婚内受赠的规定，针对存在的争议表达自己的见解，并提出自己的完善意见，以期司法实务能更好地明确婚内受赠物的归属。
[Abstract]:Marriage is not only the foundation of the family, but also the product of emotional and material integration. During the marriage relationship, the husband and wife may receive gifts from a third party outside the marriage, such as a real estate gift from a parent to a child; Or one side of the couple accepts gifts from the other, such as mutual gifts between the couple. These gifts act to stabilize family relations. But in today's society, where divorce rates remain high, divorce ends once the relationship breaks down. The attribution of the gift property may lead to a new dispute, although China's Marriage Law and its judicial interpretation have more explicit provisions on the attribution of the property, especially the real estate, to the husband and wife. However, these provisions are quite controversial. It is necessary to define the status of marriage and family and the marital property system to define the status of marriage and family and the property system of husband and wife in order to resolve the disputes and prevent the conflicts between marriage and family. Gift system and so on have a good understanding, and can balance the interests of all parties, weighing advantages and disadvantages. This paper intends to clarify the types of gifts in marriage, and elaborate on the gift system related to marriage. Based on the property system of husband and wife, this paper probes into the ownership of two kinds of typical marital gifts and puts forward some suggestions for perfection in view of the relevant laws and judicial interpretations of our country. This paper is divided into four chapters. The first chapter describes the basic situation of marital gifts, including the concept, characteristics, the scope of gifts, categories and so on. The second chapter mainly describes the relationship between marital gifts and general gifts. The article 6 of the latest Marriage Law provides that the property donation between husband and wife can be applied to the arbitrary revocation system of the general gift contract. Cause controversy. Therefore, it is necessary to pay attention to the system of arbitrary revocation. Chapter three expounds the relationship between marital gift and marital property system. The acceptance of gift by one or both spouses will inevitably lead to the change of personal property or joint property. And this change has a close relationship with the property system of husband and wife. Chapter 4th mainly introduces the Marriage Law and its judicial interpretation of the two most typical provisions of marital gifts, to express their views on the existence of disputes. And put forward their own perfect opinion, with a view to judicial practice can better define the attribution of marital gifts.
